EXPORT OF REACTOR COMPONENTS TO THE PHILIPPINES

Purpose:

To obtain Commission concurrence in a proposed letter to Westinghouse.

Discussion: The Commission is currently reviewing a proposed export by Westinghouse of components intended for use in the Philippine Nuclear Power Plant (SECY-79-100, XCOM-0013). In late April, Westinghouse requested the staff to re-examine the list of components covered by XCOM-0013 to determine if certain of the components could be exported under Commerce Department' general license. In Westinghouse's view, certain of these components were incorrectly categorized as being " specially designed or prepared" for use in a nuclear reactor.

On May 2 (Appendix A), IP requested NRR to perform a technical review of the comporants as requested by Westinghouse. This review is not yet entirely completed as NRR has required additional information from Westinghouse with respect to some 1 of the compone,nts under review. tiewever, NRR has been abl.e to determine that the Spent Resin Storage Tank, Boron Injection Tank, Floor Drain Tank, Laundry and Hot Shower Tank and the Waste Holdup Tank are not " specially designed or prepared" for use in a nuclear power reactor and may, therefore, be ex-ported under Commerce Department General License.

Since Westinghouse has expressed on several occasions the ur-gent need for the XCOM-0013 components in the Philippines, the staff believes it desirable to inform Westinghouse promptly that NRC export licensing approval is not required for the five tanks. Accordingly, the staff has prepared for Commission approval the attached draft letter to Westinghouse (Appendix B).

Recommendation: That the Commission authorize the staff to send the draft letter at Appendix B to Westinghouse.
