Gentlemen:

SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NO. 50-302/89-01)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

.P. Holmes-Ray on January 1 27, 1989. The inspection included a review of the

circumstances ' surrounding improperly sized ASCO solenoid valves installed in

the Instrument Air system. The report documenting this inspection was sent to

you by letter dated February 17, 1989. As a result of this inspection, failures

to . comply = with NRC regulatory requirements were identified and NRC concerns

relative to the inspection findings were discussed in an Enforcement Conference

held on March 6,1989.

The violations -described in the enclosed Notice of Violation involved failure

to meet. the requirements of Technical Specification 3.6.3.1 and failure to

promptly idantify and correct conditions adverse to quality.

In accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (1988) (Enforcement Policy),

the violations described in the enclosed Notice have been categorized as

> Severity Level IV problems.

The violations described in the anclosed Notice involve your identification

of a discrepant condition and failure to take proper corrective action for

approximately 60 days. At the Enforcement Conference, you attributed the root

cause to be inadequate training in that an engineering supervisor did not

recognize the safety significance of the discrepant condition. These viola-

tions are further examples of programmatic problems in the Engineering / Technical

Support SALP functional area for which you recently received a Category III.

Your response to this Notice should address both the violations and the larger

programmatic problems.

You are required to respond to this letter and the enclosed Notice and should

-follow the instructions. specified therein when preparing your response. In

your response, you should document the specific actions taken and any

additional actions you plan to prevent recurrence.
