pAB Review of Maxey Flats As a result of the site visit and evaluation of the data ,

available with regard to aquatic and atmospheric releases of radioactive material during FY 1974 the staff has developed some quantitative estimates of environmental impact as well as several positions with respect to operation of the facility.

l Aquatic Releases l The data indicate that tritium, S-active and y-active material l

are being released In the hydrosphere in unrestricted areas. In 1

our evaluation we assu=ed, conservatively, that the water would be consumed by man all year long at the conventional rate. For sites at the maximum values, the potential tritium whole body dose was calculated not to exceed 15 crem per year. For un;dentified beta and alpha emitters, including natural radioactivity, the potential doses respectively would not exceed 25 mrem par year to the whole body and 1000 mrem / year to the skeleton. These values are essentially the same as that corresponding to untreated water from the Ohio River.

Atmospheric Releases The evaporator effluent exposure was evaluated at the location of the nearest residence, about 0.5 mile north of the site. The major component of the radioactive releases, as expected, was l

tritium. This was calculated to provide a potential dose at the nearest residence which would not exceed 5 mrem per year. In .

addition traces of other nuclides are known to be present of l I

which the largest exposure is that due to Sr-90. For this i

nuclide the calculated potential bone dose would not exceed l

l l 1.5 mrem per year. '

Recommendations and Conclusions t

We conclude that there appears to be an insignificant public l

health probles associated with the release of , radioactive 1

1 material from this burial site. The Radiation Control Branch of the Dept. for Human Resources of the Commonwealth of Kentucky l

has ade'quately exercised its responsibility and is continuing to ensure that the public health and safety will be safeguarded.

The RAB staff takes the position that there is a need to measure source terms (effluent nuclide releases) and to carry out environmental radiological monitoring programs similar to those suggested in RG 1.21, 1.23, 4.1, and 4,8, and ANSI N13.10-19 74.

In particular, while we endorse items 4 and 5 $f p. 5 of the Environmental Committee report of April 4,1975, the staff takes the position that the licensee should continue to carry out, en a routine basis, nuclide analysis of both effluent releases and environmental media e.g. , fish, corn, milk, etc. The state

l I Whereas the licensee need not do project #4 for more than a year, it is our position that the evaporator release and environmental

! nedia measurements should be carried out continuously at such a frequency that the state will be able to evaluate the environmental impact from all significant pathways, such as breathing, drinking water, eating fish, etc.

Dear Governor Carroll:

9 This refers to your TWK of April 30, 1975, to Chairman Anders, requesting the Nuclear Regulatory Coussission (NRC) to assess the current situation at the Maxey Flats, Kentucky, commercial waste burial ground, and to provide you with our findings. You may recall that members of my staff met with your representatives on May 7,1975, to discuss the nature of the review which we would make. Chairman Anders' letter to you of  !

June 20, 1975, confirmed the action we were taking in response to your request.

An NRC review group was appointed consisting of staff members knowledgeable in Agreement State relationships, hydrology, and' radiological assessment to conduct this review. This group reviewed available information regarding the site, the State's December 1974 project report, the report of the State's Environmental Study Design Committee, and recent environ-mental monitoring data. The review group visited the site on June 3, 1975, and met with State and licensee offiefala on June 4 and 5, 1975.

Enclosed is the report of the NRC review groop, which includes certain recommendations for the State's consideration. The report concludes that there h no significant public health problem associated with the release of radioactive material from this burial site. It is also our conclusion that the State has been taking appropriate action concerning implementation of the recommendations as contained in the six-month study report. The recommendations deal principally with methods for improving water management at the site so as to =fn4m4re migration of radioactive material.

We have also received a latter dated May 13, 1975',' from C. Leslie Dawson, Secretary, Department for Human Resources, requesting both technie=1 and financial assistance in the conduct of the studies out-lined by the State's Environmental Study Design Committee. While we are able to provide technical assistance, we are not in a position to provide financial assistance in this matter. We are sending a copy of our report to Mr. Dawson and will, at the same time, inform him of our r
