NOTE T0: File DATE: September 3,1986 RE: Disposition of Federal Register notice cross referencing thd Policy Statement regarding "Below Regulatory Concern" petitions in 52.802.

John and I discussed the manner in which we are going to deal with the FRN we worked up to publish after the Policy Statement cited above was published in the Federal Register as an' appendix to Part 2. Since the OMB clearance package indicated that NRC anticipates petitions will be received from approximately 6 petitioners and since the Consnission has requested action on an advance notice for proposed rulemaking in the near future, we have decided to hold the FRN in abeyance until we see how much activity will be generated by the policy statement. If there is a great deal of activity, we will probably move to publish the FRN; if not, we may not publit;..

We are also placing a note in Mike's inbox to indicate that we want to seetheStaffImplementationPlan(thataccompaniedthepolicystatement) definitely placed in the loose-leaf Rules and Regs handbooks. We under-stand that it will not be included in the softbound 10 CFR.
