SUBJECT:
POLICY STATEMENT REGARDING THE DISPOSAL 0F RADI0 ACTIVE WASTE BELOW REGULATORY CONCERN The Division of Rules and Records (DRR) has reviewed the subject policy statement and concurs based on your addition of the policy statement and attached staff implementation plan as Appendix B of 10 CFR Part 2.
This has been discussed with ELD, and ELD agrees that it should be in Part 2 as an i
appendix. We understand that the fonnat of the policy statement has been l
changed since we received this paper for review but that the substance of the policy statement and staff implementation plan has not been altered from what appears in the review copy. A DRR-marked copy of the policy statement is I
enclosed for your information.
Because this will become an appendix to Part 2, there are other additions that have to be made to the policy statement such as Words of Issuance, a revised Part 2 Authority Citation that adds an additional section at the end to include a reference to the Act that prompted the policy statement, and an amendatory instruction. We have indicated the places where these additional statements should be inserted.
Other comments are noted marginally.
