INTIMIDATION OF TEXAS UTILITIES GENERATING CO.

(TUGC0) QUALITY ASSURANCE AUDITORS BY TUGC0 QUALITY CONTROL MANAGEMENT (4-84-050)

Enclosed is an Office of Investigations' Report of Investigation.

The results of this investigation demonstrated that the site Quality Control (QC) supervisor disagreed in some ways with the manner in which the Quality Assurance (QA) audit program was being implemented in 1983.

Testimony regarding the subject of this investigation was taken during the Comanche Peak Steam Electric Station (CPSES) Atomic Safety and Licensing Appeal Board (ASLB) inquiry into intimidation issues.

The site QC supervisor's confrontation with the QA auditors was intended to influence and alter their conduct of audits to conform to the site QC supervisor's own preferences regarding the QA program. Unquestionably, the site QC supervisor's disposi',on was influenced by the presence of an auditor with whom he had a continuing conflict. However, the implementation of the QA program was not in the site QC supervisor's purview to alter. No evidence of discrimination was uncovered, however, the QC supervisor's threatening statement was c.alculated to influence the auditors' activities, and it was improper and constituted attempted intimidation. '

This investigation has been closed by 0I. Neither this report nor transmittal memorandum may be released outside the NRC without the permission of the Director, 01. Internal NRC access and dissemination should be on a right and need-to-know basis.
