APPLICATION FOR AMENDMENT TO OPERATING LICENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission, the New York Power Authority, as holder of Facility Operating License No. DPR-59, hereby applies for an Amendment to the Technical Specifications contained in Appendix A of this license.
The proposed amendment to the James A. FitzPatrick Technical Specifications is limited to Table 3.7-1, Note 1, and concerns the main steam isolation valve (MSIV) closure times.
The change would allow plant operation for the remainder of Cycle 8 with a minimum MSIV closure time of two seconds for one of the four steam lines.
The existing Technical Specifications require that the MSIVs close within three to five seconds.
Until this amendment application is approved, operation of the FitzPatrick plant will be limited to less than full rated power.
This operating restriction is an emergency situation as defined in 10 CFR 50.91(a) (5).
Therefore, the Authority requests that the review and approval of this application be conducted on an expedited basis as permitted by that regulation.
The proposed changes to the Technical Specifications are Attachment I to the Application for Amendment to the Operating License.
The Safety Evaluation for the proposed changes is included as Attachment II.
