FERMI 2 - RELIEF REQUESTS FOR THE FIRST 10-YEAR INTERVAL' INSERVICE INSPECTION (ISI) NONDESTRUCTIVE EXAMINATION (NDE) 1 PROGRAM (TAC NO. MA1570)

Dear Mr. Gipson:

' By letter dated April 16,1998, as supplemented by letters dated June 19 and July 27,1998, the Detroit Edison Company (DECO) requested relief from certain ISI requirements of the American

' Society of Mechanical Engineers Boiler and Pressure Vessel Code,Section XI, for the Fermi 2 plant. The ten requests for relief are related to inspections under the ISI NDE program for the first 10-year interval. By letter dated May 28,1998, the NRC staff requested additional information concerning the requests for relief. DECO responded to this request in the June 19, 1998, letter. After further discussions with the NRC staff, DECO submitted the July 27,1998, 3 letter, providing further information and withdrawing request for relief RR-A1. I l'he_ staff, with technical assistance from its contractor, the Idaho National Engineering and Environmental Laboratory, has completed its review for five of the requests for relief (RR-A17, l

A19, A20, A21, and A22). For RR-A17, A21, and A22, the staff determined that the proposed alternatives will provide an acceptable level of quality and safety; therefore, these alternatives ,

are authorized pursuant to 10 CFR 50.55a(a)(3)(i) for the first 10-year ISI interval. For RR-A19 and A20, the staff determined that imposing the requirements at issue would result in hardship J without a compensating increase in the level of quality and safety at Fermi 2; therefore, the I alternative examinations are authorized pursuant to 10 CFR 50.55a(a)(3)(ii) for the first 10-year ISI interval. The alterative contained in request for relief RR-A20 (the use of Code Case N-498-1) is authorized for the current interval or until such time as the Code Case is published in l a future revision of Regulatory Guide (RG) 1.147. At that time, if DECO intends to continue to implement this Code Case, you should follow all provisions in Code Case N-498-1 with the i limitations issued in RG 1.147, if any. A copy of the staff's safety evaluation and the associated contractor's technicalletter report are enclosed. The remaining requests for relief will be addressed in future correspondence.
