Commissioner McGaffiaan's Comments on SECY-98-180:

I am reluctantly approving the waiver requested by this paper (SECY-98-180) which primarily deals with the completion of USAID funded work in Lithuania.

I am approving because the NRC FTE burden is small (.3 FTE in FY 1999). I am deeply disappointed, however, that USAID has thus far refused to recognize the fee-based nature of NRC resources and the tremendous pressures on NRC's budget to carry out its domestic responsibilities. Other agencies fully reimburse i NRC's staff costs when we support their statutory missions. USAID should do the same.

I am not approving the companion waiver requested in SECY-98-179 because that paper involves 14 NRC FTE in FY 1999 and there is little detail in the paper on which to judge the priority of the activities to be conducted and the viability of alternative means of carrying out those activities. If USAID were willing to reimburse NRC's staff costs. I might well support a higher level of NRC involvement. But given USAID's policy on reimbursement, all of these activities (in Russia and FSU countries) are on the table for discussion in adjusting to our FY 1999 budget reductions.

' l COMMISSION WAIVER OF STAFF COST RECOVERY POLICY FOR WORK PERFORMED FOR THE U.S. AGENCY FOR INTERNATIONAL DEVELOPMENT The Commission has approved a waiver of the policy requirement for recovery of staff costs from the U.S. Agency for Intemational Development (AID) essociated with the work in Lithuania

($0.65 million and .3 FTE) and the existing Central and Eastem Europe (CEE) interagency agreement ($0.215 million and a small fraction of the Lithuania FTE). The staff should continue to pursue additional discussions with AID, including a possible Commission meeting, to seek AlD approval for providing the full recovery of NRC costs. The staff should also inform AlD that l this waiver approval does not signal a Commission position on the other reimbursable t

agreement request involving a far higher commitment of NRC FTE that is currently under review.
