This is in regards to your letter, with attachment, dated October 20, 1987 regarding the receipt of General Electric scrap zircaloy tubing contaminated with low enriched uranium.

We have reviewed your request for an exemption from the requirements of receiver measurement verification and inventory requirements as contained in the appropriate sections of 10 CFR 70.51, 70.58 and 74.15(b) as well as the coninitments contained in sections 5.6.1 and 7.9.4 of your currently approved 10 CFR Part 70 Fundamental Nuclear Material Contro'l Plan (FNMCP).

We have determined that the granting of a one-time exemption for the special nuclear material described in the attachment to your October 20,-1987 letter will not adversely affect the conrnon defense and security nor the public health and safety and is otherwise in the public interest..Accordingly, we are adding a temporary license condition (TC.1) to Amendment SG-1 to your License No. SNM-1097, effective immediately, to read as follows (Note the TC-t Series license conditions are reserved for temporary /short duration requirements):

TC.1 Notwithstanding the requirements of 10 CFR 70.58(e), 74.15(b) and j

the commitment contained in Section 7.9.4 of the.FNMCP to perform

-j independent receiver measurement; and notwithstanding the require-H ments of 70.51(d) and the commitment contained in Section 5.6.1 of l

the FNMCP to determine physical inventory quantitics based on measured values -the licensee may (for.that material described in I

the attachment to the October 20, 1987l letter) accept the shipper's special nuclear material data for both the purpose of receiver and inventory values. At physical inventory the licensee shall confirm for each SeaVan the tamper indicating seal number and integrity.
