We have completed our review of your recent revised draft chapters of the Fundamental Nuclear Material Control Plan (FNMCP) submitted pursuant to 10 CFR 74.31(b) (1) . Specifically, our review pertained to:

1. Chapter 4.0---submitted under cover letter dated September 25, 1987, with pages dated "9/25/87".
2. Chapters 2.0, 3.0, 7.0 and 9.0---all submitted under cover letter dated October 8, 1987, with pages dated "10/02/87" for Chapters 2.0 and 3.0 and "10/06/87" for Chapters 7.0 and 9.0.
3. Chapters 5.0, 6.0, and 8.0---all submitted under cover letter dated October 19, 1987, with pages dated "10/15/87".

4. Chapter 5.0 (pages 1, 5.13 and 5.21 through 5.24 only)---submitted under cover letter dated October 22, 1987, with pages dated "10/22/87".

As we previously indicated to you, your initial Chapter 1.0 submittal was deemed acceptable, and hence was not subject to further revision and review.

Your revised chapters were, for the most part, responsive to our previous comments and concerns. However, there are still a few areas that need additional clarification either by FNMCP revisions or by license conditions I (to be imposed at the time of Plan implementation). Our comments and proposed license conditions are contained in the enclosure to this letter. In accordance with our previous discussions, it is our intent to finalize our review and approval process by December 31, 1987. Fence, the enclosed '

We respectfully request you to submit a final, official revised FNMCP (with all pages having the same date and same l revision number) to be received by us no later than December 18, 1987. Your final submittal may either be ider.tical to your latest draft chapters, or you may make revisions to incorporate our proposed license conditions (or i

suggested Plan rewording). It is our intent, however, to issue a license condition for each comment (contained in the' enclosure to this letter) that is not resolved by your final Plan submittal. When granting our approval for your FNMCP, we will issue an entirely revised safeguards amendment to your license. Condition 1.1 of that revised amendment will incorporate your Plan as a condition of license. Other license conditions, as mentioned above, may be needed to resolve our comments that are not adequately addressed in your final Plan submittal. It should also be noted that you will have 60 days following our approval to implement your new FNMCP. Thus, your revised safeguards amendment will be effective 60 days from the date of our letter transmitting such amendment.

l We appreciate your effort and cooperation in finalizing this lengthy and difficult task. i We have determined that the enclosure to this letter as well as the enclosures to your September 25, October 8, October 19, and October 22, 1987 (as identified in items 1 through 4, above) all contain information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1),

such information is deemed to be commercial or financial within the meaning of 10 CFR 9.5(a)(4) and shall be withheld f rom public disclosure unless subject to the provisions of 10 CFR 9.12.
