NUCLEAR REGULATORY COMMISSION STAFF'S REQUEST FOR EXTENSION OF TIME TO FILE RESPONSE TO RANDAT I. L. HERRING'S WRITTEN PRESENTATION BACKGROUND On June 7,1998, Randall L. Herring, an applicant for a senior operator license, filed a request for hearing on the denial of his license application, pursuant to 10 C.F.R. I 2.103(b)(2).
On June 16,1998, the Presiding Officer and Special Assistant were appointed. On June 30,1998, the Presiding Officer issued his Memorandum and Order (Hearing File and Specification of Claims)
(Order), which required, inter alla. Mr. Herring to file his written presentation of arguments by Friday, August 14,1998, and the Nuclear Regulatory Commission staff (Staff) to file its response by August 28,1998.
The Staff hereby requests a two week extension of time to file its response, pursuant to 10 C.F.R. 6i 2.1203(d) and 2.711.
DISCUSSION The Staff is requesting a two week extension to file its response to Mr. Herring's written presentation. Pursuant to the Presiding Officer's Order, the Staff's response to Mr. Herring's 9008140014 900812 r

- _ _ - _ _ - - _ - _ _ _ _ _ _ _ _ _ - - _ - _ _ _ - _ _ _ _. O written presentation is due on August 28,1998. A two week extension would permit the Staff to file its response by September 11,1998. The extension is being requested due to the leave, travel, and training schedule of Staff necessary for the preparation of the Staff's response to Mr. Herring's written presentation. Pursuant to 10 C.F.R. f 2.711, wt.ich is made applicable to Subpart L proceedings through 10 C.F.R. f 2.1203(d), the extension of time limits is permitted upon a showing of good cause. The Staff submits that the unavailability of necessary Staff constitutes good cause for the requested extension of time.
Staff counsel spoke to Mr. Herring on August 6,1998 and advised him of the Staff's intention to file the within motion. Mr. Herring stated that he has no objection to the requested extension.
CONCLUSION Based upon the foregoing, the Staff respectfully requests that its motion for an extension of time of two weeks to respond to Mr. Herring's written presentation be granted.
