Dear Mr. Langenbach:

By your letters dated June 3,1998, containing both proprietary and non-proprietaq versions, you l

responded to the staff's request for additional information related to the subject license amendment requet1. You requested that information contained in your June 3,1998, proprietary I

response letter be considered proprietary and requested that it be withheld from public disclosure pursuant to_10 CFR 2.790. However, you did not include a separate affidavit, referring instead to the affidavit submitted with your original application dated March 31,1997, as the basis for the L

proprietary claim. By telecon with members of your staff we informed you that the information l

contained in your June 3,1998, letter required a separate affidavit supporting any proprietary claim in order for the staff to consider your request for withholding from public disclosure. You provided this affidavit dated July 9,1998, and executed by Joseph J. Kelly, Manager, B & W l

l Owners Group Services by a letter dated July 13,1998. A non-propnetary version was submitted i t

for placement in the NRC public document room.

You stated that the submitted informat:on should be considered exempt from mandatory public disclosure for the following reason:

The use of the information by a non-member would decrease his expenditures, in time or resources, in designing, producing or marketing a similar product.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information.

Therefore, the version of the submitted information marked as proprietary will be withheld from /

l public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of //

l 1954, as amended.

Withholding from public inapection shall not affect the right, if any, of persons property and j directly concemed to inspect the documents, if the need arises, we may send copies of this (M[

information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
