Commissioner Diaz's Comments on SECY-98-117 l
l approve the proposed use of a probabilistic approach in determining whether the Shelwell site may be released for unrestricted use. I want to commend the staff for approaching the Shelwell license termination in a risked informed manner and find the probabilistic approach a refreshing l approach to realistic regulations. Although the maximum dose from an individual particle could l be as high as 500 mrem, the maximum lifetime risk of fatal cancer for a 30-year period of 1.1E-07 is a risk of less than the 25 mrem annual dose limit in the license termination rule.
l believe it is important to work with the State of Ohio on termination of this license in light of their preference for some type of restriction on site use after termination because of the potentially high maximum dose and Ohio's intent to become an Agreement State. However, I disapprove
- the Option 2 approach and support Option 1 instead, which provides Ohio with the opportunity to provide input during the process, including public meetings. I agree with Commissioner McGaffigan that if an Agreement is not concluded with the State of Ohio on their projected schedule, the license termination process would be prolonged and could negatively impact the licensee's financial ability. NRC has an obligation to serve its licensees effectively and efficiently. If Ohio does not support the action to terminate the license, I support the staff seeking approval from the Commission before taking action to terminate the license as discussed in SECY-98-117..
