Pursuant to 10CFR50.90 and 10CFR 2.790, attached are proposed changes to the Improved Technical Specifications (ITS) related to the implementation of Westinghouse fuel at McGuire and l

Catawba Nuclear Stations.

Topical Report DPC-NE-2009/DPC-NE-2009P, Duke Power Company Westinghouse Fuel Transition Report,

's attached, and provides in Chapter 8, a description and technical justification for the proposed ITS changes. The version of this topical report designated DPC-NE-2009F contains information that Duke considers PROPRIETARY. In accordance with 10CFR 2.790, Duke requests that this information be withheld from public disclosure.

Accordingly, in accordance with the guidance contained in NUREG-0390, enclosed are 15 copies of the proprietary version and 12 copies of the non-proprietary version of this topical report.

An affidavit which attests to the proprietary nature of the affected information is included with this letter.

NRC approval of the proposed ITS changes and the accompanying topical report is needed prior to the implementation of the Westinghouse fu4l at McGuire and Catawba.

By letter dated May-27, 1997 (Reference 1), Duke Energy Corporation submitted to the NRC the license amendment requests (LAR) to convert the McGuire and Catawba Current l

Technical Specifications to the McGuire and Catawba ITS.

Duke l

Energy Corporation has submitted subsequent supplements to the l

ITS as shown in References 2-7, with the potential of future L

supplemental ITS submittals before the implementation of the first batch of Westinghouse fuel at Catawba (currently l

scheduled for Unit 2 Cycle 11, startup approximately April l

2000); and at McGuire (currently scheduled for Unit 2 Cycle L

14, startup approximately July 2000).

The requested changes to the ITS are marked up on pages current as of the supplemental submittal shown in Reference 7.

Duke anticipates approval of ITS by September 1998 and when received, new marked up Technical Specification pages will be L

This will ensure agreement with the NRC approved version of ITS, and resolve any possible difficulties related to supplements submitted between the time of this submittal and the implementation of the Westinghouse fuel at each particular unit.

Duke is requesting review and approval of this

topical report concurrently with the proposed ITS changes.

The addition of Topical Report DPC-NE-2009/DPC-NE-2009P supplements the documents already listed in the ITS 5.6.5.

These existing documents remain current and are unaffected by this LAR.

Pursuant to 10CFR50.92, Attachment 4 contains a No Significant Hazards Consideration Determination for the proposed ITS changes.

Pursuant to 10CFR51.22 (c) (9), Attachment 5 provides a basis for categorical exclusion from performing an Environmental Assessment / Impact Statement.

S. Nuclear Regulatory Commission July 22, 1998 Page 4 This LAR will impact the McGuire and Catawba Updated Final Safety Analysis Reports (UFSARs).

Necessary changes to the UFSARs will be made in accordance with 10CFR50.71(e).

i Duke Energy Corporation is requesting review and approval of the changes contained in this LAR and the accompanying topical

[

report by June 1, 1999 in order to support reload fuel design activities for both McGuire and Catawba.

The first installation of the Westinghouse fuel is to be in Catawba Unit 2 Cycle 11, currently scheduled for startup in April 2000.

Duke is asking that the proposed McGuire changes be reviewed and approved concurrently with the proposed Catawba changes, j

and that they become effective for each unit upon implementation of Westinghouse fuel at each particular unit.

This amendment request has been reviewed and approved by the I

applicable McGuire or Catawba Plant Operations Review Committee and the Duke Corporate Nuclear Safety Review Board.

Pursuant to 10 CFR 50.91(b) (1), a copy of this amendment is being provided to the appropriate State of North Carolina and State of South Carolina officials.

(a)

It allows Duke to reduce vendor and consultant expenses associated with supporting the operation and licensing of nuclear power plants.

(b)

Duke intends to sell the information 1a nuclear utilities, vendors, and consultants for the purpose of supporting the operation and licensing of nuclear power plants.

(c)

The subject information could only be duplicated by competitors at similar expense to that incurred by Duke.

Public disclosure of this information is likely to cause harm to Duke because it would allow competitors in the nuclear industry to benefit from the results of a significant development program without requiring commensurate expense or allowing Duke to recoup a portion of its expenditures or benefit from the sale of the information.
