EXTENSION OF EDO DUE DATE WITS 910033. RIN 3150-AE07 refers to an ongoing rulemaking action involving Licenses-for Radiography and Radiation Safety Requirements for Radiographic Operations,10 CFR Part 34, that was published as a proposed rule on 2/28/94 59 FR 9429.

Subsequent to publication of the proposed rule, and based upon comments received, the NMSS and RES staff concluded that two provisions of the proposed rule were not cost effective and could be withdrawn from the final rule: S 34.41, which stipulates that at all locations other than permanent radiographic installations, two radiographer or ' one radiographer and one assistant radiographer are required, and S 34.43, which stipulates that all radiographer must be certified through an appropriate certifying organization.

Since this reconsideration was made known, the NRC has been deluged with letters from the industry and from Agreement States arguing for retention of these two provisions on the basis of the safety improvement involved. Some have argued that the history of overexposure for radiography bear out these arguments. The State of Texas provided a summary of overexposure in Texas but RES requested some clarifying information from Texas in May to enable it to better assess the current situation prior to making a final decision.

To date, this information has not been received.

On the basis of the above information it is requested that the due date for the final rulemaking be extended to August 25, 1995 in order to provide time to properly evaluate Agreement State and industry data and comments received since April.
