Commissioner McGaffiaan's comments on SECY-98-059:

I support Option 2 with thet following comments and modifications.

. Our overall regulatory program provides us insights into the management performance of licensees. ' I am reluctant to discontinue the staffs practice of inferring managerial performance from the data we have (as Option 1 would do). On the other hand, efforts to systematize and expand current practice will, in my view,' prove liiusory. ' I do not, therefore, support Options 3, 4, or 5. Even Option 2 envisions development of guidance "to allow a more systematic method.

Yet earlier in the paper the staff states "it was concluded that a management assessment based on current inspection program data would not likely result in a leading indicator of plant performance and would not result in a comprehensive and direct assessment of licensee management performance."

In light of these conclusions, my approval of Option 2 is limited to those elements associated with the current staff practice of inferring licensee management performance from performance-based inspections, routine assessments, and event followup. I join with Commissioner Dicus in supporting the elimination of any resource expenditures in attempts to develop a systematic method of inferring management performance.

. The Commission, after considenng the five options contained in SECY 98-059 for ensuring that L

heensees maintain competent management at their nuclear plants, approved only those elements of Option 2 associated with the current staff practice of inferring licensee j

management performance from performance-based inspections, routine assessments, and j

event follow up.. Efforts to develop leading indicators of performance should not use licensee management performance or competency as an input, and the inspection program should focus on performance-based inspection findings.

The Commission approved the elimination of any FY 1998 resource expenditures specifically
