While I commend the' staff on this effort, I disapprove the issuance of the subject draft generic letter at this time.
The staff should continue to work with NEI and other stakeholder, and strive to finalize an NEI guidance document that can be promptly endorsed by the NRC.
During'the open Commission meeting on June 4, 1998, NEI stated that they expected to reach " closure with the staff" such that an endorsable.NEI guidance document would be available "by the end of the year."
I want to give NEI and the staff a fair chance to succeed in this endeavor, especially in light of the significant gains in clarity and efficiency compared to having two different draft guidance documents simultaneously in the hands of
. stakeholder. Should the process break down, however, or appear to reach an impasse, the staff should promptly notify the Commission.

STAFF REQUIREMENTS - SECY-98-087 - PROPOSED GENERIC LETTER 98-XX: INTERIM GUIDANCE FOR UPDATED FINAL SAFETY ANALYSIS REPORTS IN ACCORDANCE WITH 10 CFR 50.71(e)
The Commission has disapproved issuance of the proposed generic letter for public comment at this time. The staff should continue to work with NEl and other stakeholder, and strive to finalize an NEl guidance document that the NRC can endorse. The staff and NEl should reach closure by December 31,1998. If agreement is not reached by that date, the staff should issue the draft generic letter for comment in the following week. Should the staff and NEl reach an impasse before December 31, the staff should promptly notify the Commission so that the Commission can reconsider issuance of the draft generic letter.

Mganwhile, the staff should ensure that inspections do not use the draft generic letter.
Completeness and accuracy of the FSAR should be tied together and accomplished within six months, for risk significant items (for other information, the updated FSAR must be complete and accurate within 18 months), of the issuance of either 1) the NRC endorsement of the NEl guidance or 2) issuance of the generic letter. Enforcement discretion should be extended until that time.
