Dear Dr. Voth:

Your February 20, 1989 letter expressed concerns regarding the application of 10 CFR 50.70 to non-power reactors. The following will clarify the regulations and our implementation of them as applied to non-power reactors.

The only part of 10 CFR 50.70 that applies to non-power reactors is Section. 50.70(a),

which authorizes inspections. Section 50.70(b) does not apply to non-power reactors.

The applicability of Sections 50.70(b)(1), (2) and (3) is affirmed in the' Summary of i

the Statement of Considerations for the final rule promulgating these sections, wherein it is stated that these sections apply to " power reactor licensees and construction permit holders and selected fuel facility licensees" (Federal Register j

Notice 44FR47918). Moreover, Section 50.70(b)(4) clearly states that it applies to i

" nuclear power reactors only," not to non-power reactors.

Your letter referred specifically to letters from Region I to Cintichem as the basis for your concern. Cintichem presents a special case.

Cintichem holds both Part 50 and Part 70 NRC licenses in order to produce radio-isotopes for commercial uses.

Production and separation operations are routinely conducted on a 24-hour-a-day scheoule.

In order for NRC to conduct appropriate inspections of this facility in accordance with Sections 19.14(a), 50.70(a), and 70.55(a), it was necessary for certain NRC inspectors to have unescorted access to the facility. This was to ensure reasonable access to the facility during off-normal hours, and to minimize the impact of unannounced inspections on the licensee's small staff.

The NRC and Cintichem have already agreed on a procedure to permit such access; therefore, no current disagreement exists between Cintichem and the NRC. The NRC continues to believe that such access is covered by current regulations.
