State of certain of the Commission's regulatory authority over byproduct, source and special nuclear materials became effective on June 1, 1987. A copy of the agreement and of Part 150 of the Comission's regulations, wh'ich describe the scope of the transferred authority, are available from this office upon request..
Certain.1icensees conduct licensed activities within the State of Illinois but maintain mailing addresses outside of this state. With the exception of federal and certain other licensees, such activities are subject to the regulatory authority of the Illinois Department.of Nuclear Safety. Dear Licensee:
On June 1, 1987, Illinois was designated an Agreement State by the United States Nuclear Regulatory Commission (NRC).
Under terms of the Agreement Illinois has assumed jurisdiction over byproduct, source, and special nuclear materials in quantities not sufficient to form a critical mass. Consequently, the Department of Nuclear Safety will hereafter license and inspect use of the above materials in Illinois.
The Illinois Department of Nuclear Safety looks forward to working with you in this new program and will take the necessary step'; to accomplish a smooth transition. Accordingly, we are enclosing a list of questions and answers to provide additional information about the Illineis Agreement State program.
Generally, the Department's procedures for regulating radioactive materials will be similar to the NRC's. As you know, Illinois has had a licensing program for naturally occurring and accelerator produced radioactive materials since 1974. The program, which was designed after Nuclear Regulatory Commission procedures for licensing bypr.oduct, source, and special nuclear materials, will continue to be similar.
A copy of the recently revised regulations (32 Ill. Admin. Code, Chapter II) has been sent to you previously.

Dear Mr. Eastvold:
We nave received a letter frun Dr. William J. Adams, State Agreement Program Officer, U.S. NBC, Region III indicating that the above referenced license has been placed under the jurisdiction of the Illinois Departsnent of Nuclear Safety as part of your State Agreement Program.
This letter is to notify your that all activity authorized by license number 13-15544-01 has, and will continue to occur, solely within the State of Indiana. Due to the lccation of our Gibson Generating Station in Gibson County, Indiana it is necessary to use a Mount Carrnel, Illinois address. This was probably the reason the NRC transferred this license to Illinois.
We request that license number 13-15544-01 be returned to U.S. NRC Region III. We are informing Region III of this request by copy of this same letter.

Each sealed source containing licensed material, other than Hydrogen-3, I
with a half-life greater than thirty days and in any form other than gas I
shall be tested for leakage and/or contamination at intervals not to I
exceed six months; except those sealed sources as specified by the l
manufacturer and specifically authorized by the Commission or an Agreement State may be ' leak tested at intervals not to exceed three years.
In the absence of a certificate from a transferor indicating i
that a test has been made within six months prior to the transfer, a l
sealed source received from another person shall not be put into use until tested.

Any source in storage and not being used need not be tested. When the source is y
removed from storage for use or transfer to another persons, it shall be tested y
before use or transfer.

The test shall be capable of detecting the presence of 0.005 microcurie of radioactive material on the test sample.
If the test reveals the presence of 0.005 microcurie or more of removable contamination, the source shall be removed from service and decontaminated, repaired, or disposed of in accordance with Comission regulations. A report shall be filed within 5 days of the date the I
leak test result is known with the U.S. Nuclear Regulatory Commission, Region III, 799 Roosevelt Road, Glen Ellyn, Illinois 60137, ATTN: Chief, Nuclear Materials Safety and Safeguards Branch. The report shall specify the source involved, the test results, and corrective action taken. Records of leak test results shall be kept in units of microcuries and shall be maintained for inspection by the Comission. Records may be disposed of following Comission inspection.
D.
Tests for leakage and/or contamination shall be performed by the licensee or by other persons specifically licensed by the Comission or an Agreement State to perform such services.
- 16. The licensee shall conduct a physical inventory every six (6) months to account for all sealed sources received and possessed under the license. The records of the inventories shall be maintained for two (2) years from the date of the inventory for inspection by the Comission, and shall include the quantities and kinds of byproduct material, manufacturer's name and model numbers, location of sealed sources and the date of the inventory.
- 17. Except as specifically provided otherwise in this license, the licensee shall conduct its program in accordance with the statements, representations, and procedures contained in the documents including any enclosures, listed below.
The Nuclear Regulatory Comission's regulations shall govern unless the statements, representations and procedures in the licensee's application and correspondence are more restrictive than the regulations.

Conditions 18. and 19. are added:
- 18. The licensee shall assure that the shutter mechanism is locked in the closed position during periods when a portion of an individual's body may be subject to the direct radiation beam. The licensee shall also modify their " lock-out" procedures whenever a new gauge is obtained for use other them purposes for which they are currently authorized to incorporate the device manufacturer's recommendations.
