This will acknowledge" receipt of your letter dated February 13, 1989 and your check for $100,000Lin' payment for the civil penalty proposed by NRC'in a letter dated January 13, 1989. We noted that while you agree the. violations occurred, you disagree.with the NRC's characterization of. the actions of certain SMUD supervisors and managers. Given the longstanding nature of the violations and the previous NRC concerns in the area of control of radioactive effluents we conclude that our letter properly conveyed our conclusions. Your corrective actions will be examined during future inspections.
