ASME.SECTION XI CODE CASE N-401-1 OCONEE, MCGUIRE, AND CATAWBA NUCLEAR STATIONS (TAC Nos. 69249 through 69255)

.In an August 15,'1988 letter and pursuant to 10 CFR 50.55a(c)(3), you informed the'NRC of your intention to: incorporate Code Case N-401-1 of the ASME Boiler and Pressure Vessel Code into the Inservice Inspection Programs at each of' Duke Power Company's nuclear stations unless informed that it is not acceptable for use. Since 10 CFR 50.55a(c)(3) requires that ASME Code Cases must have been

. determined suitable for use by the NRC, and Code Case N-401-1 has not received generic approval for use by the NRC as of the latest revision (Revision 6) of.

f Regulatory. Guide (RG) 1.147 pursuant to'10 CFR 50.55a(a}(your letter is viewed as a request for NRC approval 3).

Code' Case N-401,." Eddy Current Examination," was approved by the ASME on February 20,-1984 and is referenced in Revision ~6 of RG~ 1.147 without additional limitations. Therefore, as noted in rqy letter to you on December 1,1988, Code Case N-401' is acceptable to the NRC staff for application in the inservice-inspection of components.

.A revision.to the above Code case, designated Code Case N-401-1, has also been approved by the ASME. Both documents address the use of digitized -

collection and storage of eddy current test data when performing examination based on ASME Section XI, Appendix IV. The revision'to the Code case has a clarification with regard to specific calibration requirements contained in Appendix IV that apply only to analog instrumentation.

The staff has reviewed Code Cases N-401 and N-401-1. We find these two documents to be technically equivalent. Therefore, pursuant to 10 CFR 50.55a(a)(3)(1) the staff finds that Code Case N-401-1 provides an acceptable level of quality and safety and is acceptable for use as requested.
