Dear Mr. Hoffman:

The Commission has recently sent a notice (copy enclosed) to all holders of NRC import licenses which imposes a requirement to notify the Commission at least 60 days in advance of any contemplated import of South African-origin uranium. The Comnission requests the cooperation of the Treasury Department in assurinq that any such imports, when clearing Customs, are accompanied by adequate proof that this advance notification requirement has been met.

RECORD OF EETING WITH EDLOW INTERNATIONAL  !

COMPANY ON SOUTH AFRICAN URANILM IWORTS On May 8,1987, NRC staff met with officials of Edlow International Company concerning Edlow's recent import of South African origin natural urania.

Attending for NRC were Harold Denton, GPA; James Lieberman, DE; Jack GoldbeM , OGC; James R. Shea, GPA; and Marvin Peterson, GPA. Attending for Edlow were Jack Edlow, President and Rodney Fisk, Manager, International l Affairs.

Mr. Denton opened the meeting by expressing concern that Edlou had imported in March 1987 a large quantity of South African origininnatural uranium a letter dated despite the fact that NRC had requested the Company (ial of South African February 4,1987) to refrain from importing any mater origin while NRC was reviewing South African imports and to inform the Commission in advance of any intention to import such material.

Mr. Edlow responded that the February letter was.only a request and that, without an order from the NRC, Edlow was not legally obligated to keep the Comisission informed of the Company's intentions regarding imports under its still valid import license. Mr. Edlow indicated that his company had a i

i long history of compliance with NRC licensing requirements and intended to '

continue to fully cooperate with NRC to the degree clearly specified in its licenses. With regard to South African uranium imports, Mr. Edlow noted that Edlow's import was in confonmance with Executive Branch policy and the Treasury Department's recently published regulations and that if the Comission had a different view it should Providedtake such action to fonnally fonnal amend action was taken, Edlow's existing taport licenses.

With regard to future actions, Mr. Denton asked Mr. Edlow if his company could take steps to preclude further use of the imported material in the U.S. Mr. Edlow stated that his firs had no capability to store the material and that, in any case, it was now in the possession of the Kerr-McGee Corporation in Oklahoma. Without further formal action by the Connission. Mr. Edlow also would not commit to notifying NRC of any additional planned imports under his license, although he did indicate that none were planned in the near future (2-3 weeks). In response to questions from Mr. Shea. Mr. Edlow stated (1) that his firm had not imported any other South African material since December 31. 1986 and (2) that the Department of Energy was "probably" aware of Edlow's March import from the owner of the material. Mr. Denton then closed the meeting by stating that the Commission would now proceed to consider its course of action on the matter. Mr. Edlow expressed his thanks for the opportunity to present his views and reaffirwed his conaitment to comply fully with the Commission's formal license requirements.
