DENIAL OF REQUEST FOR EXEMPTION FROM ANNUAL REPORTING REQUIREMENTS 1

0F 10 CFR 50.54(a)(3) and 10 CFR 50.71(e)(4) l In your letter of June 11, 1987, you requested a schedular exemption from the 10 CFR 50.54(a)(3) and 10 CFR 50.71(e)(4) requirements for filing the annual quality assurance program update and the Final Safety Analysis report revision for calendar year 1987.

To remain in compliance with these provisions, these reports were required to be filed with the NRC by July 2, 1987.

Your proposed exemption requested that this reporting deadline be extended to September 2, 1987.

The circumstances presented in your June 11, 1987 request do not satisfy the requirements for special circumstances needed to justify an exemption as required by 10 CFR 50.12, " Specific Exemptions." Consequently, your request for exemption is hereby denied.

Failure to submit these reports to the NRC by July 2, 1987 constitutes a non-compliance with the requirements of 10 CFR 50.54(a)(3) and 10 CFR 50.71(e)(4).

BG&E will be considered to be in non-compliance until the sub-mission of reports that adequately meet the regulatory requirements.
