STATEMENT OF WORK FOR TECHNICAL SUPPORT FOR LLWM FOR URANIUM RECOVERY LICENSING ASSISTANCE, FEE RECOVERABLE FIN TBD, B&R 150 19 33-03

1.0 BACKGROUND

The Nuclear Regulatory Commission's Division of Low Level Waste Management and Decommissioning needs technical assistance to support the NRC staff activities in carrying out the requirements of the Uranium Mill Tailings Radiation Control Act of 1978.

The NRC is required to concur with the Department of Energy's (DOE) selection and performance of remedial actions at UMTRA Project sites.

To fulfill its responsibility, NRC reviews site assessments to ensure con;pliance with nvironmental Protection Agency (EPA) standards contained in 10 CFR Part 192 entitled, " Health and Environmental Protection Standards for Uranium and Thorium Mill Tailings." Foll ming completion of remedi.1 actions, the NRC will license long-term custody of tailings disposal sites to ensure protection of human health and the environment.

All work to be performed under this Interagency Agreement is fee recoverable in accordance with the provisions of 10 CFR Part 170 and is subject to the requirements of Part IV, Section 15 of NRC Hanual Chapter 1102, 2.0 OBJECTIVE The objective of this project is to provide LLWM staff with technical assistance in support of the Uranium Hill Tailings Remedial Action UMTRA)

Project. Work perfurmed will assist the NRC in fulfilling its responsibilities under the Uranium Hill Tailings Radiation Control Act of 1978, as amended.

An additional objective of this project is to provide LLWM staff with technical support on reviews of operating Uranium recovery facilities (Title II) in accordance with the requirements in 10 CFR Part 40.

The primary need is to assist the NRC staff in the review and evaluation of proposed remedial actions to determine if EPA standards for immediate and long-term protection of the public from both radiological and nonradiological hazards posed by residual radioactive materials are met.

Technical assistance will support ongoing and future reviews of remedial action plans for UMTRA Project sites.

Furthermore, the NRC requires assistance in analyzing environmental issues, and a steady source of state-of-the-art scientific and technical knowledge.

3.0 SCOPE OF WORK Upon receipt of an executed SF173, the performing organization will perform independent assessments of proposed disposal sites, Uranium Recovery facilities and designs which will (1) supplement the Division's review capability, and (2) apply specialized technical expertise to solve generic r

2 and site spesific issues related to remedial actions. Assessments will involve, but are not l'imited to, document reviews, site visits, construction inspections, and data reviews and verifications.

The performing organization will interact with the NRC task order project manager and DOE and its consultants to identify and resolve technical issues related to meeting EPA standards, Work associated with this project will be task-driven and subject to sch duling changes by DOE.

Document reviews will often be initiated on short notice, and product delivery schedules will likely have rapid turn-around times.

Work under this, project shall include, but not be limited to, the following task areas:

Task Area 1 - Document Reviews This task area involves providing site asscssments in the form of document reviews.

The performing organization's work will center around assisting LLWM staff in review, analysis, and critique of DOE documentation for generic and site-specific remedial actions.

Review u k is directed towards identifying and resolving scientific, technical and administrative issues with respect to meeting EPA standards.

Task Area 2 - Site Assessments Support LLWM on site assessments by visiting inactive processing sites and proposed disposal sites.

Site visits will have the dual purpose of providing reviewers an opportunity to make first-hand observations of tailings piles and their environs, and to inspect the quality of data provided in remedial action documents.

Task Area 3 - Review Guidelines Assist LLWM staff in-the development of review guidelines related to site monitoring. The project will include participation in designing and implerr.cnting monitoring programs to assure compliance with EPA's standards for lorg-term tailings stability, protection of nearby residents from radiat:on, and protection of ground water.

Task Area 4 - Regulatory Guidance Provide technical support for LLWM staff in the development of regulatory guidance.

Guidance development is required in a number of areas related to the mill tailings program, including: (1) attenuation of hazardous constituents escaping the tailings piles, (2) design and implementation of i

monitoring programs, (3) efficiency and effectiveness of site cleanup programs, and (A) methods for determining long-term geologic stability.

Task Area-5 --Dam Safety Provide technical support for LLWM staff in determining compliance witn NRC's dam safety program.-

e To support the above task areas, technical expertise is rsquired.in_ civil and geotechnical engineering, health physics, geology, hydrogeology, and geochemistry.

This expertise will be applied in reviewing alternate-disposal site selections, site characterization, remedial-action designs, certification reports, proposals for. surveillance and maintenance, and l

- proposed alternate remedial criteria. Additional expert assistance is

- recuired to support NRC participation in data reviews, workshops, data z

aucits and inspections, and licensing reviews.

~4.0 WORKING PROCEDURES This project will-provide support to LLWM staff during periods of peak work loads'and will provide LLWM staff with specialized expertise not available in the staff.

As the exact number and scheduling of specific tasks cannot be~ determined, the' detailed-scope of work for each required task will be defined and funding provided via a SF173.

The NRC will designate a Project Manager who will be responsible for the overall technical direction of the task ordering project.- A Task Order Project Manager will, in turn, be

- assigned to each specific Task and will be responsible for monitoring the technical work for that Task.

When specific work requirements are identified.-the NRC will issue task orders in the form of Standard Orders for DOE Work (NRC Form 173).

Each task order will specify all pertinent information regarding the work to be performed including the following, as applicable:

Technical Monitor (TM).

The specific work rec.uired on each case will-be established in writing by the PM with schecules developed in conjunction with the performing organization.

Whe.e applicant information is inadequate, the performing organization will identify

-additional information needed to the TM. -The TM~will discuss the basis for questions to ask the applicant with the performing organization.

-5.0 REPORTING REQUIREMENTS I

5.1 MONTHLY LETTER STATUS REPORT (MLSR)

The perforing organization shall-submit a Monthly Letter Status Report (MLSR) submitted by the 20th day of each month with distribution as stated in Section 5.2.

In addition the Director, Prgram Management, Policy Development and Analysis Staff, NMSS/PMDA should be on the distribution list.

The recommended format for the MLSR should contain the -following sections:

a Work Progress Status Section and a Financial Status Section.

Work Performed During the Reporting Period This section should contain a clear, succinct discussion of the work performed on the task order during the period.

As a minimum the discussion should support the costs Tor the reporting period.

Verbiage such as " worked on all tasks", or "Mr. XXXXX worked on task 2" are not particularly useful and reduce the effectiveness of the MLSR as a managenent tool and for historical documentation.

Any travel taken during the reporting period should also be summarized in this section of the report.

Each travel summary should identify the person (s) traveled, the duration of the travel, the purpose of the travel, and a-summary of the work accomplishments.

Problems / Resolution All problems encountered during the period shall be clearly and succinctly identified and stated. Then, the resolution or the proposed resolution should be briefly described.

It should be clearly evident from a reading of the description who has the action to solve the problem, should it still exist at the time the report is written.

All problems, regardless of status, should be recorded in the

" Problem / Resolution" section of the MLSR for documentation and historical reference purposes.

If the problem still exists in a subsequent month, in whole or in part, it should be described as it currently exists; otherwise it should be deleted from the report.

Problems or circumstances that require a change in the level of effort or costs, scope or travel requirements are to be described in the MLSR for documentation purposes but are to be dealt with separately in a letter addressed and sent to the NHSS PM with a copy to the HMSS TM.

Plans for the Next Period Provide a brief description of the work to be performed or accomplished during the next reporting period.

If a milestone is expected to be completed during the next reporting period, so state.

SECTION II - CONTRACT FINANCIAL STATUS SECTION 1)

Provide the total direct staff effort used, the amount of funds expended (costed) during the period, the total amount of funds costed during the current fiscal year to date, and the cumulative amount of funds costed (all fiscal years) to date.

The costs should be reported as whole numbers rounded to the nearest dollar. The financial status shall be reported for each task order and a total contract summary in the format depicted in NRC Manual Chapter 1102, Part IV, Figure 1 (Note: the format may vary from contractor to contractor depending on the accounting categories used).

5.2 TASK REPORTS Draft and final versions of all formal reports (one copy each) covering authorized tasks shall be forwarded to the NMSS PM; the NMSS TM; the Chief, Uranium Recovery Branch and to the NRC Document Control Center as soon as the documents are available.

For each task, the performing organization shall prepare a draft report as specified in individual task orders in accordance with the established schedules, that provides the basis and justification for the reviewers' results and conclusions.

l Within 30 days of receipt of the draft task report, the NMSS TM will provide comments to the performing organization for appropriated resolution and incorporation in a final report.

Final task reports shall then be submitted j

within 30 unless another time period is stated in the individual task order.

7 6.0 MEETINGS For planning purposes, the performing organization should anticipate two meetings at NRC headquarters on each task for project management review.

It is expected that the NHS$ TM will visit the performing organizations' offices at least twice during the course of each task.

Attendance at hearings held near the site may be required.

In addition, it is expected that the NMSS PM will visit the performing organization for a program review on a yearly basis.

7.0 NRC FURNISHED MATERIAL Copies of appropriate documents will be provided to the performing organization,oy the NMSS TM or PM as they become available, 8.0 PERIOD OF PERFORMANCE The period of performance for this work commences on the effective date of this agreement and shall continue through December 31, 1993.

9.0 TECHNICAL / PROJECT DIRECTION David Tiktinsky (FIS 492-0656)

Project Manager TBD Technical Monitor The NMSS PM is the focal point for all contract related activities. All work assignment and program funding actions are initiated by the NMSS PM.

All proposed work scope or schedule changes must be processed through the NHSS PM.

The NHSS TM is responsible for providing technical guidance to the performing organization regarding staff interpretations of the technical aspects of regulatory requirements along with copies of relevant documents (e.g. Regulatory Guides) when requested by the performing organization. All work products must be reviewed and approved by the NMSS TM before they are submitted as final documents. All technical direction given to the performing organization must be consistent with the work scope and schedule.

The HMSS TM is not authorized to unilaterally make changes to the approved work scope or schedule or give the performing organization any direction that would increase costs over approved levels.

Directions for changes in. cost or period of performance will be provided by

-the DOE Operations Office after receipt of an appropriated Standard Order for DOE Work (SOEW) (NRC Form 173) from the Office of Nuclear Material-Safety and Safeguards, if the performing organization receives guidance which is believed to be invalid under the criteria cited above, the L

performing organization shall immediately notify the NMSS PM.

If the NMSS PM and the performing organization are unable to resolve the question within five-days, the performing organization shall notify the DOE Operations Office.

8 10.0 QUALITY ASSURANCE 10.1 For all draft and final reports delivered under this agreement, the performing organization shall assure that an independent review and verification of all numerical computations, mathematical equations, and 2

derivations are performed by qualified personnel other than the original author (s) of the reports.

if the performing organization proposes to verify / check less than 100 percent of all computations and mathematical equations andTeilvations in the reports (s) (such as might be the case when

' there are a large number of routine, repetitive calculations), the performing organization must first obtain written approval from the NHSS PM.

Computer generated-calculations will not require verification where the computer program has already been verified.

The NMSS PM or TM has the option of_ auditing all documentation includirig project correspondence, drafts, calculations and unrefined data.

10.2 In addition, all reports, including those which do not contain numerical analyses, must be reviewed by the performing organization's management and approved with two signatures, one of which is for the -

performing organization's management at a level above the program manager.

10.3 The performing organization will take into account NRC comments on draft reports and revise final reports accordingly.

11.0 DISPOSAL OF PROPERTY l

Prior to closecut of this project, a reconciled report shall be developed by DOE to record available equipment and material purchased with NRC funds.

The report should contain the MOU property description or nomenclature, manufacturer, model number, serial number, quantity, acquisition cost, receipt date, condition code, and DOE or contractor property identification number.

The report shall also identify any ongoing or contemplated NRC projects on which the MOV property could be used, if no MOU property is assigned-to the project, the DOE shall provide a negative report. Any MOU property requiring special handling for security, health, safety or other reasons shall be noted as part of the report.

This report should be submitted as soon as possible after a project completion or termination decision has been made, but not later than 60 days after the termination date. The report should be submitted to the Office of NMSS, Attention: PMDA.

12.0 DOE ACQUIRED MATERIAL The performing organization must notify the Office of Nuclear Material Safety and Safeguards (Attn: Director, PMDA) and the NMSS PM prior to acquisition of any capital, ADP, or work processing equipment.

Prior to purchase of property with NRC funds, DOE shall conduct utilization reviews of DOE and other appropriated sources of unrequired, excess and surplus

property. Property identified during these reviews-that meet NRC project needs shall be transferred to the project in lieu of purchase.

DOE shall monitor M00 property assigned to the project on a regular basis-to identify unrequired MOU property.

Unrequired MOV property shall be reported to NRC for utilization screening using the procedures followed for M00 property disposa! at project closecut.

13.0 ESTIMATED LEVEL OF Eff0RT The estimated total level of effort required to perform this work is-2 staff years per year for the'first two years and 1 staff year for the third year for both the fee and non-fts recoverable tasks (both this FIN and FIN L1375).
