SUBJECT: NRC INTEGRATED INSPECTION REPORT 50-321/98-01. 50-366/98-01 AND

NOTICE OF VIOLATION

Dear Mr. Sumner:

On March 21. 1998, the NRC comaleted an inspection at your Hatch facility.

The enclosed report presents tie results of that inspection.

During the six-week period covered by this inspection report, your conduct of

activities at the Hatch facility was generally characterized by safety-

conscious operations, sound engineering and maintenance practices and careful

radiological work controls. However, violations of NRC requirements were

identi fied.

The violations are cited in the enclosed Notice of Violation (Notice), and the

circumstances surrounding the violations are described in detail in the

enclosed report. We are concerned about your staff's failure to conduct

adequate surveys and to follow radiation protection procedures which could

result inadvertent and unnecessary personnel exposure.

In addition. failure to follow maintenance procedures resulted in maintenance

being performed which was not authorized by a maintenance work order and was

done outside of the approved clearance boundary, similar to an instance

identified and documented in Inspection Report 50-321. 366/97-02. Repetitive

violations are addressed in the NRC's " Statement of Policy and Procedure for

NRC Enforcement Actions. " (Enforcement Policy). NUREG-1600.Section IV.B.

The Enforcement Policy allows the severity level of a violation to be

increased if the violation can be considered repetitive. For example, a

Severity Level IV violation could be increased to Severity Level III with the

attending escalated enforcement action. However. in this case, we have

decided not to increase the severity level of this violation based on the

safety significance of the violation and your overall satisfactory performance

in this area.

In addition. an apparent violation was identified and considered for escalated

enforcement action in accordance with the ~ General Statement of Policy and l

Procedures for NRC Enforcement Actions" (Enforcement Policy). NUREG-1600. The

apparent violation involved your identification of uninstalled temperature

switches of the "A" and "B" Main Control Room Environmental Control (MCREC)

system which left a hole of approximately one half inch diameter in each

filter train, which could have allowed unfiltered bypass flow to enter the

main control room. This could have resulted in control room personnel

receiving a thyroid iodine dose in excess of 30 rem during and following a

design basis accident. This apparent violation will be addressed in a

separate correspondence.

Please note that you are required to respond to this letter and should follow

the instructions specified in the enclosed Notice when preparing your

response. The NRC will use your response. in part, to determine whether

further enforcement action is necessary to ensure compliance with regulatory

requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice." a copy of

this letter, its enclosures, and your response will be placed in the NRC

Public Doca.?ent Room (PDR).
