APPLICATION FOR AMENDMENT TO OPERATING LICENSE Pursuant to Section 50.90 of the Regulations of the Nuclear Regulatory Commission, Niagara Mohawk Power Corporation (NMPC), holder of Facility Operating License No. NPF 69, hereby requests that Table 3.3.3-1, Action 36 of the Technical Specifications (TS) set forth in Appendix A to that license be amended. The proposed changes have been reviewed in accordance with Section 6.5, " Review and Audit," of the Nine Mile Point Unit 2 (NMP2) TS.

The proposed changes revise NMP2 TS Table 3.3.31, " Emergency Core Cooling System Actuation Instrumentation," Action 36, to allow the action to be in effect for plant conditions where more than one channel is inoperable per trip function in the High Pressure Core Spray (HPCS) drywell pressure and reactor water levelinstrumentation. The changes will give NMP2 the capability of declaring the HPCS system inoperable, thus avoiding a {

i plant shutdown per TS 3,0.3. Presently, if the plant has more than one channel per trip function inoperable, as happened on March 26,1997 when NMPC requested discretionary enforcement from the NRC, the plant is in a TS 3.0.3 condition. This is a result of inappropriate wording added by a previous amendment that changed Action 36 of Table .

3.3.31. This proposed amendment will ensure that the plant condition of having more than one channel per trip function inoperable in the HPCS drywell pressure and reactor water levelinstrumentation will be properly addressed by TS.

The proposed changes will not authorize any change in the types of effluents or in the authorized power level of the facility in conjunction with this Application for License Amendment. Supporting information and analyses which demonstrate no significant hazards considerations pursuant to 10CFR50.92, are included as Attachment B.

WHEREFORE, Applicant respectfully requests that Appendix A to Facility Operating License No. NPF-69 be amended in the form attached hereto as Attachment A.
