Appeal of FOIA 85-59
Dear Mr. Stello:
This is an appeal pursuant to subsection a(6) of the Freedom of Information Act as amended (5 U.S.C.
522),- of the actual denial of the Commission to release documents requested on January 21, 1985 by the Government Accountability Project (GAP) regarding the Comanche Peak Task Force established in March 1984.
By letter dated June 11, 1986, Mr. Donnie Grimsley, i
Director of the Division of Rules and Records advised us that of I
the 192 QA/0C documents described on Appendix V, 25 entire docu-ments and portions of 66 documents were being withheld pursuant to FOIA Exemption 5.
Twenty-one of the documents were determined to contain legal work product and the remainder contain the advice, opinions and recommendations of the staff concerning potential violations.
In addition, Mr. Grimsley advised us that portions of 54 documents were being withheld pursuant to "the agreement reached between you and the NRC staf f at a meeting on May 8,1985."
To the extent these documents relate to anyone but "allegers" we appeal their denied release.
