Appeal of FOIA 85-59

Dear Mr. Stello:

This is an appeal pursuant to subsection a(6) of the Freedom of Information Act as amended (5 U.S.C.

522), of the actual denial of the Commission to release documents requested on January 21, 1985 by the Government Accountability Project (GAP) regarding the Comanche Peak Task Force established in March 1984.

By [[letter::IA-85-699, Responds to 860515 Appeal of 860417 Partial Denial of FOIA Request for Documents Concerning Board Notification 85-084 Re ACRS Review of Ssers 7-11 (NUREG-0797).Documents Still Withheld (Ref FOIA Exemption 5)|letter dated June 30, 1986]], Mr. Donnie Grimsley, Director of the Division of Rules and Records advised us of 520 QA/QC documents being released to the NRC Public Document Room described on Appendices BB, CC and DD.

He further informed us that of those 520 documents: portions of 40 documents and 3 documents in their entirety were being withheld pursuant to FOIA Exemption 5 because they contain the advice, opinions and recom-mendations of the staff concerning potential violations; portions of 21 documents and 9 documents in their entirety were being withheld pursuant to FOI A Exemption 7(C) because their disclosure would constitute an unwarranted invasion of personal privacy; portions of 1 document and 2 document s in their entirety were being withheld pursuant to FOIA Exemption 7(D) because their disclosure would disclose the identities of confidential sources; and portions of 1 document and 8 documents in their entirety were being withheld pursuant to FOIA Exemptions 7(C) & (D).

Mr. Grimsley also advised us that portions of 35 documents were being withheld pursuant to an agreement reached between the NRC staff and myself at a meeting on May 8, 1985, that informa-tion concerning allegers, interviewees and other individuals would be protected from disclosure.

Please be advised that our agreement applied only to allegers.

To the extent the withheld documents relate to anyone but allegers, we appeal their denied release.

We believe we are entitled to release of the documents and portions of documents being withheld.
