SUBJECT: NRC INSPECTION REPORT NOS. 50-325/98-04. 50-324/98-04

Dear'Mr..Hinnant:

On March 20, 1998, the NRC completed an inspection at your Brunswick reactor

facility. The enclosed report presents the results of this inspection.

Based on the results of this inspection. one violation was identified. We are

concerned that your staff used the results of an unverified engineering

service request as part of-the basis for changing plant design documents.

This violation is cited in the enclosed Notice of Violation, and the

i circumstances' surrounding the violation are described in detail in the

. enclosed report. Please note that you are required to respond to this letter

and should follow the instructions'specified in the enclosed Notice when

preparing your response. .The NRC will use your response, in part, to

determine whether further enforcement action is necessary to ensure compliance

with regulatory requirements.

In addition, four apparent violations were identified and are being considered

.'for escalated enforcement action in accordance with the " General Statement of

Policy and' Procedures for NRC Enforcement Actions" (Enforcement Policy). L

NUREG-1600. The apparent violations, relate to the failure to perform

response time testing in accordance with Technical Specification requirements

and. inadequate 10 CFR 50.59 evaluations which resulted in unauthorized changes

to the plant Technical Specifications. The circumstances surrounding these

appsrent violations, the significance of the issues, and the need for lasting

-and effective corrective. actions were discussed with members of your staff

during a telephone conference exit meeting on March 26. 1998. As a result, it

may not be necessary to conduct a.predecisional enforcement conference in

order to enable the NRC- to make an enforcement decision. However, a Notice of

Violation.is not presently being issued for these inspection findings. Before

the'NRC makes its enforcement decision, we are providing you an opportunity to

either (1) respond to the apparent violation addressed in this inspection

report within 30 days of the date of this letter or (2) request a

predecisional enforcement conference. Please contact Mr. Kerry Landis at

(404) 562-4605 within seven days of the date of this letter to notify the NRC

of your intended response.

Your response should be clearly marked as a " Response to Apparent Violations

in Inspection Report Nos. 50-325/98-04. 50-324/98-04" and should include for

the apparent violation: (1) the reason for the apparent violations, or, if l

contested. the basis for disputing the apparent violations. (2) the corrective -

steps that have been taken and the results achieved. (3) the corrective steps ,

that will be taken to avoid further violations, and (4) the date when full. l

compliance will be achieved. Your response should be submitted under oath or j

affirmation and may reference or include previously docketed correspondence.  ;

if the correspondence adequately addresses the required response. If an l

adequate response is not received within the time specified or an extension of '

time has not been granted by the NRC. the NRC will proceed with its

enforcement decision or schedule a predecisional enforcement conference.

In addition please be advised that the characterization of the apparent  !

violations described in the enclosed inspection report may change as a result

of further NRC review. You will be advised by separate corresp:ndence of the

results of our deliberations on this matter.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice." a copy of

this letter, its enclosure, and your response (if you choose to provide one)

your response should not include any personal privacy, proprietary, or

safeguards information so that it can be placed in the PDR without redaction.
