As you are aware, the majority of the Commission supports the Altemative 1 approach described in the subject paper-proceed to draft a new, separate part of the regulations specific to Yucca Mountain-rather than the Attemative 2 approach-revise the existing Past 60 to apply only to Yucca Mountain. I strongly supported Alternative 2 in my vote and continue to support Alternative 2 b aed, in part, on the fact that Altemative 2 may pose potentially significantly less litigative risk than Altemative 1. Subsequent to voting, I identified a strategy that I believe will reduce the potential litigative risk associated with Altemative 1 and, during the course of drafting the staff requirements memorandum on this paper, I voted to integrate the following text "The staff should consider the merits of deleting certain Part 60 generic requirements, such as those in 10 CFR 60.113 and 60.134, that the Commission no longer supports to further reduce the litigative risk that may be associated with promulgating a new, l
separate part that applies solely to Yucca Mountain."
j l proposed this insert in light of the staffs concems about resources to implement Altemative 2.
It was my view that the staff has essentially already made the case for deleting those most problematic of the Part 60 generic requirements. Ultimately, this insert was not supported by a majority of the Commission. To ins.:re a complete record of the consideration of th'-
