l Commissioner Dieus' Comments on SECY-97-300 I approve alternative 1. The staff should undertake the immediate implementation of the proposed strategy for developing site-specific regulations for the Yucca Mountain geologic repository as outlined in SECY-97-300. This includes the development of a formal rulemaking plan for Commission approval. The staff should be commended for developing a strategy that will help enable NRC to keep pace with the national high-level radioactive waste program. I encourage staff to maintain the schedule as depicted in Attachment 4, although there may be uncertainty about when EPA standards will be pulashed. The staff should immediately notify the Commission if future EPA of Congressional actions result in a potential delay in the schedule.

I support Commissioner Diaz's position that the staff consider the ICRP recommendations including an all pathways exposure limit and the use of a non-i collective dose. However, I stop short of suggesting that the all pathways limit be set at 30 mrem as suggested by ICRP.

The Commission has already set a all-pathways limit of 25 mrem in its license termination rule. I believe it is important that we remain consistent in actual values set although I believe that functionally there is no or negligible difference between the two values.
