OC REVIEW AND CONCURRENCE ON A PROPOSED RULE TO AMEND 10 CFR PARTS 2, 50, AND 51 RELATED TO DECOMMISSIONING 0F NUCLEAR POWER REACTORS Per Mr. Morris' January 26, 1995 request, OC is providing concurrence on the subject SECY paper with the following provisions:
- 1. The resource paragraph on page 4 of the revised SECY paper should be changed to read:

Resources will be reviewed during the upcoming FY,,1996-2000 internal program / budget review process.
- 2. On page 12 of the Regulatory Analysis, the paragraph should end after the second sentence.
- 3. OC notes that the proposed rule eliminates the requirement for NRC to issue a POL. When the final rule is issued, a conforming amendment would have to be made to Section 171.19 " proration" because our reactor annual fees are prorated based on the issuance date of the POL.
