10 CFR 55. INITIAL LICENSED OPERATOR EXAMINATION REQUIREMENTS, PROPOSED RULE ,

We have reviewed the subject proposed rule for compliance with the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.) and request that the following changes be made to the rule:

- . Replace the Paperwork Reduction Act Statement in the rule with Attachment 1.

- Add the revised $55.8, "Information Collection Requirements:

OMB Approval" section to the rule Attachment 2).

In addition, the preamble to the draft rule states tfiat "If a facility licensee proposes to deviate from the specific guidance contained in NUREG-1021, it should obtain NRC staff approval of the deviations." This information collection is not contained in the rule. If the intent is to make it an NRC requirement, we suggest that it be added to the rule.

Our staff has been working with the Operator Licensing Branch (0LB) to develop an OMB clearance package for the proposed rule. OLB has submitted an acceptable draft package for our review. However, if the above referenced information collection is included in the rule or in NUREG 1021, it must also be included in the OMB clearance package. Publication of the rule has been placed on hold with the Office of Administration pending IRH's approval of the clearance package.

of information. The U.S Nuclear Regulatory Commission is seeking public comment on the potential impact of the collection of information contained in the proposed rule (or proposed policy statement)'and on the following issues:

1. Is the proposed collection of information necessary for the proper performance of the functions of the NRC, including whether the information will have practical utility?

2, Is the estimate of burden accurate?

3. Is there a way to enhance the quality, utility, and clarity of the information to be collected? .
4. How can the burden of the collection of information be minimized, including the use of automated collection techniques?

(c)(4) In 5555.40, 55.41. 55.43, 55.45, and 55.59, clearance is approved under control number 3150 0101.
