PROPOSED IMPORT OF RADIOACTIVE WAETE FROM TAlWAN (APPLICATION NO. lWOO6)

Attached is an application (lWOO6) from Allied Technology Group, Inc. (ATG), Richland, Washington for the import of radioactively contaminated metals frorn Taiwan. We should appreciate your advice and assistance in the review of the application. As discussed below, we would propose that NMSS/DWM take the lead role in this effort with OSP providing comments to DWM on any aspects of the application which are of specialinterest to OSP.

The waste to be imported is from the Chinshan Nuclear Power Station and consists of approximately 626,000 kilograms (110 cubic meters if closely packed) of aluminum-bronze and nickel-copper condenser tubing contaminated on the surface with 1.3 Gbq. (36 mci) of Cobalt-60 and Cesium-137 oxides. The waste includes approximately 124,000 pieces,6.86 i

meters long and 68,000 pieces,3.42 meters long, of tubing, all 2.5 cm outside diameter. The waste is scrap tubing from condenser heat exchanger tubing repairs at the reactor. The applicant advises that the scrap would be classified under 10 CFR Section 61.55 as Class A.

Iow-level radioactive material.

The material will be shipped directly from Chinshan to ATG. Upon receipt, ATG will store the material and then decontaminate it at their Richland, Washington facility for unrestricted use.

The ATG Richland Corporation holds Radioactive Materials License No. WN-10393-1.

The secondary waste, such as protective clothing, rags, abrasives, grindings, and packing 9 fr-55 materiale, will be generated from decontaminating the tubing, and is expected to be less than 36 mCl. The applicant states that the secondary wastes willlose their identity during processing with other waste streams, and will be disposed of as ATG waste at US Ecology's l

l low-level waste disposal facility in Richland. The clean scrap metal will be recycled by ATG.

Secondary waste, such as protective clothing, rags, abrasives, grindings, and packmg materials, will be generated from decontammating the tubing, and is expected to be less than 36 mci These secondary wastes will lose their identity during processing with other waste streams, and will be disposed of as ATO waste at US Ecology's low-level waste disposal facility in Richland, Washington (contact Arvil Kraus, US Ecology, at 360-754-3733 or Diane Hallisy, Wmehinatan Department of Ecology, at 360-407-7109). The clean scrap metal will then be recycled by ATG.

Dear Mr. Hauber:

I refer to the letter from your office dateo vocember 23,1997 requesting the assistance of the Department of State in notifying the authorities on Taiwan of the proposed low-level reeficactive import described below and requesting the views of the Department of State as to whether issuance of the requested import license would be consistent with the IAEA Code of Practice on the intomational Transboundary Movement of Radioactive Waste.

NRC IWOO6 - Allied Technology Qroup, Inc. (ATG) has applied for a license to authorize import from Taiwan of radioactive scrap tubing and tube plate for decontamination and recovery of the metal far recycling. The material is from the Talwan Power Company's (Taipower) Chinshan Nuclear Power Station and consists of up to $26,000 idlograms of copper-zinc-aluminum-bronze tubing recovered from condenser / heat exchanger replaceme.it. The material consists of approximately 124,000 pieces, 6.86 meters long and 68,000 pieces,3.42 meters long of 2.5 cm diameter tubing. The tubing is surface contaminated with 1.3 gigabecquerels (38 mCl) of cobalt 60 and cesium-137. ATO plans to receive, store and then decontamim Radioactive Materials Licensu No. WN 103931.the material at its Richland, Washington facility pur The Department of State understands that the NRC is reviewing whether the proposed import cnd disposition of the Talpower scrap in the United States is consistent with domestic U.S. law and r:gulations with respect to the disposal of radioactive waste. The applicant is one of several U.S.

ccmpanies competing for this Talwan Power Company project. The Department of State has instructed the American Institute in Taiwan to Inform the authorities on Taiwan of this application. The company that obtains this Talpower contract will have to comply with all conditions imposed by the authorities on Taiwan for removal and shipment of the material. The Taiwan Atomic Energy Council has confirmed that it has no objection to the transaction in principle and that it will ensure that all arrangements for the proposed transfer are in accordance with the IAEA Code of Practice. The Department of State has concluded that the proposed transfer, regardless of which U.S. company obtains the contract for removal of the material, will be subject to all applicable U.S. and Taiwan laws and regulations and will meet the standards of the IAEA Code of Practice on the international Transboundary Movement of Radioactive Waste.

In view of the foregoing, the Department of Stats has no objectiim to issuance of the requested import license with the understanding that only the successful bidder for the Talpower contract will actually be authorized to import into the U.S. the referenced low level radioactive scrap from Tapan.
