Dear Mr. Peterson:

l By letter dated January 22,1998, Duke Energy Corporation submitted relief request No. 98-01 for the Catawba Nuclear Station, Units 1 and 2, from the requirements of the ASME Boiler and Pressure Vessel Code for the second 10-year interval program for inservice testing of pumps l

~ and valves. The staff evaluated the relief request and set forth its findings in a safety evaluation (enclosed). The staff concludes that:

Bench testing is not a Code requirement; therefore, relief fror.1 such testing for the diesel generator fuel oil system valves is not required. If testing the relief valves in place as part of the monthly diesel generator performance test, as proposed in Request for Relief l-98-01, is not consistent with OM-1 requirements, the licensee should refer to the NRC l

guidance in NUREG-1482, Section 3.4, and submit a relief request with sufficient details j

to support a proposed alternative.

Pursuant to 10 CFR 50.55a(f)(6)(i), the requested a' lternative for testing the diesel l=

generator starting air dryer discharge check valves is granted based on the staffs finding that the requirements of the Code are impractical. The relief granted is authorized by law and will not endanger life or property or the common defense and i

security, and is otherwise in the public interest giving due consideration to the burden j

that could result if the requirements are imposed on the facility.

By letter dated January 22,1998, Duke Energy Corporation submitted relief request No. 98-01 for the Catawba Nuclear Station, Units 1 and 2, from the requirements of the ASME Boiler and Pressure Vessel Code for the second 10-year interval program for inservice testing of pumps and valves. The staff evaluated the relief request and set forth its findings in a safety evaluation (enclosed). The staff concludes that:

Bench testing is not a Code requirement; therefore, relief from such tesf.ing for the diesel generator fuel oil system valves is not required. If testing the relief valves inplace as part of the monthly diesel generator performance test, as proposed in Request for Relief 98-01, is not consistent with OM-1 requirements, the licensee should refer to the NRC guidance in NUREG-1482, Section 3.4, and submit a rlsf request with sufficient details to support a proposed alternative.
