Louisiana Energy Services Claiborne Enrichment Center Annual License Fee

Dear Sir or Madam:

Louisiana Energy Services (LES) is an applicant for a 30-year materials licer.se to possess and use byproduct, source, and special nuclear material in order to enrich uranium using a gas centrifuge process. Tne Atomic Safety and Licensing Board has issued its initial de:isions with regard to issuance of the license. Several of the Board's decisions are being reviewed by the Commission. It is likely that the Commission will issue its decision on whether or not to grant LES a combined construction and operating license in the next several months.

Because the license is for both construction and operation of the facility, actual operation of the enrichrent facility would not commence for several years after the start of construction. Construction will not begin until after enrichment service contracts have been negotiated and funding for the facility has been guaranteed. This could take as long as a year after initial receipt of the license. Informal discussions with members of your stafflead us to believe that LES would qualify for small entity status and be able to defer relatively large license fees until the start of enrichment operations. LES requests formal confirmation of this. Any additional information you can provide on the expe;ted or potential license fee for the facility would be appreciated.
