Dear Mr. Morgan:
I am in receipt of your January 30,'1998, letter which provides information on the status of
-Louisiana Energy Services' (LES) pending application for a combined construction / operating license and poses questions relative to fees that may be assessed.
Your letter indicates that actual operation of the enrichment facility will take several years after the combined construction and operating license is issued. As described in 10 CFR 171, annual fees are assessed based on whether a licensee holds a valid NRC license that authorizes possession and use of radioactive material. Therefore, under current regulations LES will be subject to the NRC's annual fees once it is issued a license authorizing operations.
Enclosed is a copy of 10 CFR Parts 170 and 171 which covers license, inspecticn, and annual l
fees.
You also made inquiry as to small entity status. As we discussed in our telephone conversation of March 9,1998, our current small entity size standards are included in the attached Materials Annual Fee Billing Handbook, NUREG/BR-0238 Rev.1. At the time of billing for the annual fee, licensees are provided the small entity form. If LES determines it meets NRC's small entity size standards as described in 10 CFR 171.16(c) (62 FR 29213) and so certifies by filing NRC Form l
526 at the time it receives and pays the annual fee invoice, the annual fee would be reduced.
NRC Form 526, Gertification of Small Entity Status, is filed concurrently with the payment of the l
_ annual fee invoice and is a self-certification. A sample of the current FY 1997 NRC Form 526 j-is also enclosed.
