Appeal of FOIA 86-380 g
Dear Mr. Stello:
This is an appeal pursuant to subsection a(6) of the Freedom of Information Act as amended (5 U.S.C.
522), of the Commission to release documents requested by the Government Accountability Project (G.A.P.) regarding the Inspection Report 85-16/85-13 of the Comanche Peak nuclear power plant on May 16, 1986.
By letter dated August 21, 1986, Donnie H. Grimsler, Director of the Division of Rules and Records informed us that the documents identified on Appendex D are being withheld from Public disclosure pursuant to Exemption (5) of the FOIA (5 U.S.C. 552 (b)(5)) and 10 CFR 9.5 (a) (5) of the Commissioner's regulations.
We believe we are entitled to the release of the documents being withheld.
We expect your response to this appeal within 20 working days of your receipt of this appeal so that we can cetermine whether to pursue this matter futher on the courts.
