Dear Ms. Garde:
This is in partial response to your letters dated February 26 and 28, 1986, which appealed Mr. Donnie H. Grimsley's letters dated December 3 and 24,1985, and February 24, 1986, with regard to the denial of portions of 12 documents and 3 documents in their entirety. These documents were subject to your Freedom of Information Act (F0IA) request for documents related to the NRC Comanche Peak Task Force.
Acting on your appeal, I have carefully reviewed the record in this case and l
have determined that the previously withheld information in thirteen documents will continue to be withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Connission's regulations.
Therefore, your appeal concerning thirteen documents is denied.
Documents A-11 and A-77 were initially denied pursuant to Exemption (4) of the F0IA because they contain commercial information provided in confidence to the NRC. The originators of these documents have been requested to review the documents in order to help NRC make a determination if any portions can now be made publicly available.
I will inform you later of my determination concerning these two docurrents.
Document C-352 is a draft which is clearly predecisional because it was prepared i
prior to and in the course of reaching a final agency decision. This document describes preliminary staff thinking and, therefore, contains preliminary advice, opinions, and recommendations of the staff. Exemption (5) was intended to permit the agency's withholding of such documents to preserve the free and candid internal dialogue necessary for the careful formulation of agency decisions.
As stated in Mr. Grimsley's December 3,1985 letter, the withheld portions of documents C-254, C-257 through C-262, C-584 through C-586, C-625, and C-631 relate to the subject of potential violations. - The withheld portions were predecisional to the issuing of the enforcement action on Comanche Peak.
I Exemption (5) shields from mandatory disclosure information generated in the deliberative process that precedes most decisions of government agencies.

The disposition of those records is described below.
Documents identified at numbers 56 and 57 on Appendix C are being placed in the NRC Public Document. Room (PDR) in file F0IA-85-59 under your name.
Documents 39, 58, 68,161, 227, and 252 are being withheld from public disclosure pursucnt to Exemption (7)(D) of the FOIA (5 U.S.C. 552(b)(7)(D))
and 10 CFR 9.5(a)(7)(iv) of the Comission'.s regulations because they contain the names of allegers and other identifying information concerning individuals who provided information to the NRC during the agency's investigative activities. These records are being withheld in their entirety because their release would disclose the identity of confidential sources.

Felton dated May 15,1985), portions of documents 249, 250, and 251, and portions of the remaining documents listed above which are not addressed individually by specific F0IA exemptions have been deleted because they contain names and other identifying informa' tion concerning allegers, interviewees, and other individuals whose privacy could be invaded by disclosure of this information.
The nonexempt portions of all the documents included in the Appendix C list above are being placed in the POR in file F01A-85-59 under your name. A separate set of the records placed in the POR under cover of this letter is also being made available for. public inspection and copying at the Local Public Document Room located at the University of Texas Library, 701 South Cooper Street, Arlington, Texas.

112, 113, 145, 243, 296, and 426 are being(withheld from public Documents disclosure pursuant to Exemption (7)(C) of the F0IA 5 U.S.C. 552(b)(7)(C))
and 10 CFR 9.5(a)(7)(iii) of the Coninission's regulations. These records contain personal information regarding several individuals.
The release of this information would constitute a clearly unwarranted invasion of personal privacy. There are no reasonably segregable portions of these documents, and they are being withheld in their entirety.
Documents 425 and 702'through 711 are being withheld from public disclosure pursuant to Exemptions (6) and (7)(D) of the F0IA (5 U.S.C. 552(b)(6) and-(7)(D)) and 10 CFR 9.5(a)(6) and (7)(iv) of the Commission's regulations.
These records contain personal privacy information, the names.of allegers, and other identifying information concerning individuals who provided infonnation to the NRC during the agency's investigative activities. This agreement was suninarized in a letter to you from Joseph M. Felton, dated May 15, 1985.
The information that has been deleted consists of names and other identifying infonnation concerning allegers, interviewees, and other individuals whose privacy could be invaded by disclosure of this information.

Pursuant to the Freedom of Information Act ("FOI A"), 5 U.S.C. 5 552, the Government Accountability Project (" GAP") requests copies of any and all agency

This request includes all agency records as defined in 10 C.F.R. 6 9.3a(b) and the NRC Manual, Appendix 0211, Parts 1.A.2 and A.3 (approved October 8,1980) whether they currently exist in the NRC official

If any records as defined in 10 C.F.R. $ 9.3a(b) and the NRC Manual, supra, and -
covered by this request, have been destroyed and/or removed after this request, please provide all surrounding records, including but not limited to a list of all records which have been or are destroyed and/or removed, a description of the action (s) taken relevant to, generated in connection with, and/or issued in order to implement the action (s).

GAP is a non-profit, non-partisan public interest organization concerned with honest and open government. Through public outreach, the Project promotes whistleblowers as agents of government accountability. Through its Citizens Clinic, GAP offers assistance to local public interest and citizens groups seeking to ensure the health and safety of their communities. The Citizens Clinic is currently assisting several citizens groups, local governments and intervenors in the central Texas area concerning the construction of the Comanche Peak nuclear power plant.
