This is in further response to your letter dated June 26, 1986, in which L you appealed Mr. Donnie H. Grimsley's letter dated May 28, 1986.

Mr. Grimsley's letter denied documents in whole or _in part that were subject to your Freedom of Infonnation Act (F0IA) request for documents related to the NRC Comanche Peak Task Force.

My letter to you, dated May 8, 1987, stated that the NRC was contacting the originator of a document concerning a proprietary claim. The response from General-Electric has been received and reviewed, and I f

, have determined that the previously withheld information will continue to be withheld from public disclosure pursuant to Exemption (4) of the

~

F0IA (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Conunission's regulations. Your appeal is, therefore, denied.

Document U-12 provides an analytical model for the determination of potential boiling water reactor fuel movement from a combined safe shutdown earthquake and loss-of-coolant accident svent, as well as an engineering-evaluation of the loadings on the fuel from such a combination of individual events. General Electric considers'this type of information

as consnercial information (proprietary) the disclosure of which would harm its competitive position. This information has been held in confidence by General Electric and was provided to the NRC in confidence. ,

This is a final agency action. As set forth in the F0IA (5 U.S.C.

! 552(a)(4)(B)), judicial review of this decision is available in a '

district court of the United States in the district in which you reside

or have your principal place of business or in the District of Columbia.

Dear Ms. Garde:

This is in further response to your letter dated January 21, 1985, in which you requested, pursuant to the Freedom of Information Act (FOIA), records related to the NRC Comanche Peak Task Force established in March 1984.

We are now placing two boxes of records (boxes 11 and 12) in the QA/QC category in the NRC Public Document Room (PDR) in file F01A-85-59 under your name. In particular, with the exception of three records indicated by asterisks on the enclosed Appendix T, which are undergoing further staff review, we are making available for public inspection and copying at the PDR the 131 records listed on the enclosed Appendix T and the 130 records listed on the enclosed Appendix U.

The records identified at number 34 on Appendix T and number 42 on Appendix U contain information that is being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the-Commission's regulations. The withheld portions contain the advice, opinions, and-recomendations of the staff concerning potential violations. The record identified at number 12 on Appendix U contains information that is being withheld from public disclosure pursuant to Exemption (4) of the F0IA (5 U.S.C. 552(b)(4))

i and 10 CFR 9.5(a)(4) of the Commission's regulations because it is comercici

, information which was provided in confidence to the NRC. The nonexempt portions of these records are being placed in POR file F0!A-85-59 under your name.

Portions of the records identified at numbers 4 through 14, 17 through 19, 22 through 24, 26 through 28, 30 through 33, 35, 36, and 127 of Appendix T and

numbers 2 and 3 of Appendix U are being deleted without invocation of an FOIA exemption in accordance with the agreement reached between you and the NRC staff

, at a meeting on May 8, 1985. .The information deleted consists of names, personal information, and identifying details concerning allegers, interviewees, and l other individuals.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld pursuant to Exemptions (4) and (5) of the F0IA is exempt from production or disclosure and that its production or disclosure ts contrary to the public interest. The persons responsible for this denial are the um!crsigned and Mr. Harold R. Denton, Director, Office of Nuclear l Reactor Regulation.

Ms. Garde This denial may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

A separate set of the released records is being made available for public inspection and copying at the Local Public Document Room (LPDR) located at the University of Texas Library,170 South Cooper Street, Arlington, Texas.

Additional boxes of records subject to your request are currently under review and will be placed in the PDR and LPDR in the coming weeks.
