Gentlemen:

SUB4CT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-369/86-21 AND 50-370/86-21)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

W. Orders on June 21 - August 20,1986. The inspection included a review of

activities authorized for your McGuire facility. At the conclusion of the

inspection, the findings were discussed with those members of your staff iden-

tified in the enclosed inspection report.

Areas examined during the inspection are ' identified in the report. Within these

areas, the inspection consisted of selective examinations of procedures and

representative records, interviews with personnel, and observation of activities

in progress.

The inspection findings indicate that certain activities appeared to violate NRC~

requirements. One violation, with references to pertinent requirement's and

elements to be included in your response, is described in the enclosed Notice of

Violation.

Two violations described in the enclosed Inspection Report are under consideration

for escalated enforcement action. Accordingly, no Notice of Violation is being

issued at this time for those vi.olations, and no response to those violations is

required. However, please be advised that the number and characterization of

violations described in the enclosed Inspection Report may change as a result of

further NRC review. You will be advised by separate correspo.ndence of the results

of our deliberations on this matter. Additionally, an enforcement conference will

be scheduled for October 1986 in Atlanta.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title

10, Code of Federal Regulations a copy of this letter and its enclosures will

be placed in the NRC Public' DoctSent Room.

The responses directed by this letter.and its enclosures are not subject to the

clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act'of 1980, PL 96-511.
