SUBJECT: NOTICE OF VIOLATION
(NRC INSPECTION REPORT NOS. 50-369/87-04 AND 50-370/87-04)
This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by
W. Orders and S. Guenther on December 30, 1986, through February 10, 1987. The
inspection included a review of activities authorized for your McGuire
facility.
At the conclusion of the inspection, the findings were discussed
with those members of your staff identified in Inspection Report
Nos. 50-369/87-04 and 50-370/87-04 sent to you with a letter dated March 4,
1987.
Areas examined during the inspection were identified in the report.
Within
these areas, the inspection consisted of selective examinations of procedures
and representative records, interviews with personnel, and observation of
activities in progress.
The inspection findings indicated that certain activities appeared to violate
NRC requirements.
These apparent violations were discussed with you and
members of your staff during an Enforcement Conference held on April 16, 1987.
The violations, references to pertinent requirements, and elements to be
included in your response are described in the enclosed Notice o' Violation.
Violation A described in the enclosed Notice is similar to a violation
contained in the Notice sent to you by our letter dated July 2,1986. Because
"similar violations," as described in the NRC Enforcement Policy, are of
significant concern to the NRC, please give particular attention in your
response to the identification of the root cause of this problem (i.e., the
operator's apparent lack of familiarity with the function of equipment that he
authorized to be removed from service) and your corrective action to prevent
recurrence.
Your recent good record of compliance with Technical
Specifications causes this issue not be further escalated.
We commend you for your initiative in identifying the removed curbing around
the containment air return fans as cited in Violation 0 of the enclosed Notice,
and we look forward to further results from the improvements in your management
controls which were discussed in our March 6, 1987, management meeting. The

significance of this issue was based on your past good perfoncance in the area
of refueling maintenance.
In accordance with 2.790 of the NRC's " Rule of Practice," Part 2, Title 10,
Code of Federal Regulations, a copy of this letter and its enclosure will be
placed in the NRC Public Document Room.
The responses directed by this letter and its enclosure are not subject to the
clearance procedures of the Office of Management and Budget as required by the
Paperwork Reduction Act of 1980, PL 96-511.
