NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTY (NRC INS 9ECTION REPORT NOS. 50-206/86-17, 50-361/86-12, AND 50-362/66-12)

This refers to the routine safeguards inspection conducted by Mr. D. Schaefer of this office on April 21-25, May 13-15, and June 2, 1986, of activities authorized by NRC License Nos. DPR-13, NPF-10 and NPF-15 for the San Onofre Nuclear Generating Station (SONGS), Units 1, 2 and 3. The findings of this inspection were transmitted to you on June 17, 1986. An enforcement conference ,

was also held at the Region V office on June 26, 1986, with Mr. M. Wharton and '

other members of the SCE staff. Based on the results of this inspection and as discussed during the enforcement conference, it appears that some of your licensed activities were not conducted in full compliance with NRC requirements.

Violation I in the enclosed Notice of Violation and Proposed Imposition of

, Civil Penalties (Notice) relates to your failure to immediately implement l the Safeguards Contingency Plan in response to an event. The NRC is particulagly i concerned about your failure to activate your Safeguards Contir.gency Plan in a' l real situation under circumstances identical to those described in the plan.

l Although the licensee and the NRC have been unable to confirm whether or not an

unauthorized individual actually intruded into the vital area, your failure to l- immtdiately implement the provisions of your Safeguards Contingency Plan when an employee reported an unidentified person was inside the vital area constitutes a serious violation. To enphasize the importance of fully implementing and maintaining the provisions of your approved Safeguards Contingency Plan, I have been authorized, after consultation with the Director, Office of Inspection and Enforcement, to issue the enclosed Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $25,000 for the violations described in the enclosed Notice.

r .: m 7;7 q .g Southern California Edison Company In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986) (Enforcement Policy),

Violation I has been categorized as a Severity Level III violation. The base civil penalty for a Severity Level III violation is $50,000. The NRC Enforcement Policy allows for re. duction of a civil penalty under certain circumstances. In this case, the base civil penalty is reduced by fifty percent because of your prior good enforcement history in the safeguards area. No further mitigation is appropriate because of your delay in performing a comprehensive evaluation of the event.

Two other violations of lesser significance are described in the enclosed Notice and have been categorized at Severity Level IV and V.

You are required to respond to this letter and you should follow the instructions specified in the Notice when preparing your response. In your response, you should describe those specific actions taken or planned that are designed to prevent recurrence and to increase the effectiveness of the management of your security program, particularly with regard to ensuring that all commitments in your approved Safeguards Contingency Plan are met. You should place all Safeguards Information as defined in 10 CFR 73.21 only in enclosures, so that your letter may be placed in the Public Document Room.

The material enclosed contains Safeguards Information as defined by 10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, with the exception of the cover letter, this material will not be placed in the Public Document Room and will receive limited distribution.

The response directed by this letter and the enclosed Notice are not subject to the clearance procedures of the OTfice of Management and Budget as required by.

the Paperwork Reduction Act of 1980, PL 96-511.
