SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATING TO AMENDMENT NO. 93 TO FACILITY OPERATING LICENSE NO. DPR-36 MAINE YANKEE ATOMIC POWER COMPANY MAINE YANKEE ATOMIC POWER STATION DOCKET NO. 50-309 INTRODUCTION AND BACKGROUND By letter dated February 3, 1986, Maine Yankee Atomic Power Company requested several changes to the Administrative Controls Section of the Technical Specifications for the Maine Yankee Atomic Power Station. A brief description and our evaluation of these changes is below:

1. The licensee proposed to add to the Technical Specifications provisions for limiting overtime of staff personnel in a new Section 5.8.4. In the proposed section, the licensee states that " Administrative procedures shall be established to limit the working hours of plant staff who perform safety-related functions, specifically, ifcensed senior operators, licensed operators, auxiliary operators, radiological 3 controls technicans, and key maintenance personnel." The word specifically would limit the administrative procedure to those designated positions. The Commission Policy Statement on Limitation of Working Hours at Nuclear Power Plants states that the working hour limitation applies to the plant staff who perform safety-related functions (e.g. , senior reactor operators, reactor operators, auxiliary operators, health physicists, and key maintenance personnel).

By telecon January 15, 1987, the licensee agreed to use the exact wording of the Commission Policy Statement in their Technical Specifications. This does not change the substance of the amendment as requested by Maine Yankee Atomic Power Company in their February 3, 1986 letter. This change was made in order to bring the wording of the Technical Specifications to be exactly the same as the Commission Policy Statement.

We conclude that the proposed addition of Technical Specification 5.8.4 as agreed in the telecon of January 15, 1987 conforms to the Commission Policy Statement on Nuclear Power Plant Staff Working Hours, and therefore, is acceptable.

2. The licensee proposed to revise Sections 5.2.1.g, and 5.3.1 to allow for the use of the dual role of a Senior Reactor Operator and a Shift Technical Advisor by including provisions that would allow the use of Option 1 or Option 2 of the Commission Policy Statement on Engineering Expertise on Shift.

I We conclude that the proposed change is acceptable as it meets the Commission Policy Statement on Engineering Expertise on Shift.

ENVIRONMENTAL CONSIDERATION This amendment relates to changes in recordkeeping, reporting, or administrative procedures or requirements. Accordingly, this amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of this amendment.

CONCLUSION We have concluded, based on the considerations discussed above, that (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, and (2) such activities will be conducted in compliance with the Commission's regulations, and the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public. .
