SUPJECT: EXEMPTION FROM SUBMITTAL DATE FOR UPDATED FINAL PA7ARDS
SUMMARY
REPORT (FHSR) (TAC 6?240,55078) re:
Big Rock Point Plant The Commission has issued the enclosed Exemption from the schedular requirements of 10 CFR 50.71(e)(3)(ii) in response to your reauest dated August 27, 1986 as supplemented December 3, 1986. This request was made in order to allow tir.e for NRC staff and Consumers Power Company to resolve NRC staff concerns regarding a'previously reviewed alternative to providing an updated FHSR.
By a letter dated August 27, 1984, the NRC staff issued the " Final Integrated Plant Safety Assessment Report" (IPSAR), NUREG-0828, documentino the completion of the Systematic Evaluation Program review for the Big Rock Point Plant. This same letter notified CPC that pursuant to 10 CFR 50.71(e)(3)(ii),
CPC was required to submit an updated FHSR as outlined in Section 5.3.25.1.
By letter dated December 4, 1984, NRC staff responded to the proposed program description and stated that although the details for implementation of the system were not yet clear, the system being developed would be an acceptable alternative to an updated FHSR.
Subsequent to submittal of the Final FHSR Cross Index, the NRC staff has recently identified concerns with the proposed system. By submittal dated December 3, 1986, CPC summarized the results of several discussions regarding NRC concerns and has also, by the same letter, comitted to provide an updated FHSR by December 31, 1988. Therefore, in order to provide sufficient time for the completion of the updated FHSR, CPC has requested an exemption to the i
schedular requirements of 10 CFR 50.71(e)(3)(iii.
The NRC staff has evaluated CPC's August 77, 1986 request for exemption as supplemented December 3,1986. The results of the NRC staff evaluation are described in the enclosed Exemption. The staff finds that the request for exemption from the requirements of 10 CFR 50.71(e)(3)(iil provides sufficient basis and presents special circumstances within the meaning of 10 CFR 50.12(a)(2)(iii) such that the exemption is being granted from the schedule for submittal of an updated FHSR.
