Gentlemen:

SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 50-458/86-31)

This refers to the physical security inspection conducted by Mr. J. A. F. Kelly

'

of this office on September 10, 1986, of activities authorized by NRC

Operating License NPF-47 for River Bend Station, and to the discussion of our

findings with Mr. W. J. Cahill and other members of your staff at the

conclusion of the inspection.

Areas examined during the inspection included physical barriers - vital area,

compensatory masures, and security organization management. Within these

areas, the inspection consisted of selective examination of procedures and

representative records, interviews with personnel, and observations by the ,

inspector. The inspection findings are documented in the enclosed inspection

report.

Certain of your activities were found not to be conducted in full compliance

with NRC requirements. In accordance with the " General Statement of Policy and

Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the a

' violation described in the enclosed Notice has been classified at Severity  :

Level IV. The violation, described in the attached Notice of Violation. {

involves a degraded vital area barrier. As indicated fa Supplement III of the

i

NRC Enforcement Policy, significant violations of this type are normally

classified at Severity Level III. However, after careful consideration of the

facts that the subject barrier was a vital-to-vital barrfer, all of the people

present in the power block during the degraded period were atthorized, and the i

door in question is difficult to open, we have exercised our judgment under the )

-NRC Enforcement Policy and have classified this violation as Severity Level IV.

Similar violations of this type in the future may result in additional ,

i enforcement action.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your

response, you should document the specific actions taken and any additional

- actions you plan to prevent recurrence. We request that your response

specifically address the causative factors that contributed to this

occurrence. Those factors appear to include a lack of prompt maintenance on

cardreaders and control room alarms and due consideration for employee working

4 conditions. After reviewing your response to this Notice, including your ,

proposed corrective actions, the NRC will determine whether further NRC

enforcement action is necessary to ensure compliance with NRC regulatory

requirements.

The material enclosed herein contains Safeguards Information as defined by

10 CFR Part 73.21 and its disclosure to unauthorized individuals is prohibited

by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, the

material, with the exception of the report cover page, which is an inspection

susanary, will not be placed in the Public Document Room.

The response directed by this letter and the accompanying Notice is not

subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Reduction Act of 1980, PL 96-511.

Should you have any questions concerning this inspection, we will be pleased

to discuss them with you.
