SUBJECT:

CLOSURE OF DIFFERING PROFESSIONAL OPINION ON SETPOINTS AND ALLOWABLE VALUES On February 16,1999, you issued your formal decision to Frederick Burrows concerning his Differing Professional Opinion (DPO) on the use of allowable values in lieu of trip setpoints in Technical Specifications. On March 23,1999, Mr. Burrows provided comments on that final decision.

Management Directive 10.159, " Differing Professional Views or Opinions," Section C(3),

provides that after the Executive Director for Operations or Commission makes a decision on a DPO, the matter is considered closed and will not be considered further " absent significant new information." I reviewed Mr. Burrows' March 23,1999, memorandum to decide if it contains significant new information. Further, Jocelyn Mitchell of my staff not only reviewed the memorandum herself, but also consulted with Margaret Federline, chair of the DPO ad hoc review panel, and Scott Newberry, Deputy Division Director, Division of Regulatory Improvement Programs, NRR. We all agree that there is no significant new information.

Based on that determination, I recommend that you inform Mr. Burrows that you consider the matter closed. I will provide a copy of Mr. Burrows memorandum, this memorandum, and your j memorandum to Mr. Burrows to Human Resources for inclusion in the DPO case file. l l

On March 23, 1999, you provided comments on the final decision.

I understand that you are dissatisfied with the process and the outcome of your DPO.

Nonetheless, I want to reiterate my thanks for your participation in the Differing Professional Opinion process. The willingness of staff members like you to bring issues to my attention is important to the Agency's accomplishment of its mission.
