Dear Mr. Skowronski:

s A U.S. Nuclear Regulatory Commission (NRC) staff employee submitted a Differing Professional Opinion (DPO) related to the Chemetron Corporation project at Bert Avenue in Newburgh Heights, Ohio. The DPO process is an agency review process that enables staff to present for formal resolution opinions that differ from NRC management decisions. The DPO concerned the slope stability analysis performed by Chernetron Corporation and the review of it performed by other NRC staff. We coordinated this review with geotechnical staff from the Ohio Environmental Protectiva Agency (OEPA), which was responsible for ensuring the disposal cell i complied with OEPA requirements for solid wastes.

The DPO panel reviewed the documents that were the basis for the NRC decision to issue to Chemetron Corporation a license amendment authorizing a change in the protocol for testing wastes to ensure the wastes had adequate strength to minimize the possibility of a disposal cell slope failure. The panel concluded that the site is suitably stable and that conservatisms incorporated into the analyses are judged to be reasonable to overcome the concems of the DPO submitter. We are, therefore, proceeding to terminate the license. One of the panel's conclusions was that it was not clear how the studies satisfied the requirements of OEPA and sufficiently addressed OEPA issues of uncertainty. Based on this conclusion, we are forwarding a copy of the DPO panel report to you for information and any action you deem appropriate.
