Gentlemen:
SUBJECT: NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTY
(NRC INSPECTION REPORT NOS. 50-338/86-08 AND 50-339/86-08)
This refers to the Nuclear Regulatory Commission (NRC) security inspection
conducted on March 25-28, 1986, at your North Anna Power Station, Mineral,
Virginia. The purpose of the inspection was to review a March 13, 1986,
security incident reported by you and later described in your letter of
March 18, 1986. The findings of our inspection were discussed with you
at an Enforcement Conference held in the Region II Office on April 9, 1986.
The violation identified during the inspection involved a contract employee
gaining access to the protected area without being identified, searched, or
.
badged. Although the employee was authorized unescorted access to the

protected area and the employee remained unescorted for only about two minutes
'
before reporting to the security office, the NRC is particularly concerned
about this violation because of a similar violation which recently occurred at
your Surry Station.
It is our conclusion that the violation was the result of
l
inadequate attention to security-related responsibilities by the contract
employee at the North Anna Station.
To emphasize the need for improved management attention to physical security
access control, I have been authorized, after consultation with the
Director, Office of Inspection and Enforcement, to issue the enclosed Notice
of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty-
Five Thousand Dollars ($25,000) for the violation described in the enclosed
Notice.
In accordance with the " General Statement of Policy and Procedure for
NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986) (Enforcement Policy),
the violation described in the enclosed Notice has been categorized as a
The base value of a civil penalty for a Severity Level III
violation is $50,000. The NRC Enforcement Policy allows for reduction of a
civil penalty under certain circumstances.
In this case, the base civil penalty
is reduced by 50 percent because of your prompt identification and reporting

and your prompt and extensive corrective action. However, further mitigation
is not warranted because of your prior security enforcement history and your
prior notice of similar events.
Specifically, your enforcement history
demonstrates weaknesses in implementing corrective actions for prior similar
problems at your other facility. A prior similar incident at your Surry facility
should have ensured that you would take adequate protective measures at North
Anna. Although Virginia Electric Power Company's memorandum informed the North
Anna security staff of the recent event at Surry, insufficient corrective
actions were taken to prevent its recurrence.
Additionally, in 1985, another
access control problem was identified at Surry.
Later, the same type of
problem was identified at North Anna.
Because of your failure to implement
corrective actions to prevent the incident at North Anna, a civil penalty for a
Severity Level III violation (EA 85-91) was proposed. This history is indic-
ative of a pattern of failure to implement corrective actions at both
facilities for problems identified at one facility.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your response,
you should document the specific actions taken and any additional actions you
plan to prevent recurrence.
After reviewing your response to this Notice,
including your proposed corrective actions, the NRC will determine whether
further NRC enforcement action is necessary to ensure compliance with NRC
regulatory requirements.
In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and
security measures are exempt from public disclosures; therefore, the enclosures
to this letter, with the exception of the report cover page which represents a
nonexempt summary, will not be placed in NRC's Public Document Room.
The responses directed by this letter and the enclosed Notice are not subject
to the clearance procedures of the Office of Management and Budget as required
by the Paperwork Reduction Act of 1980, PL 96-511.
